Yemeni Citizen Who Forged Marriage Book To Be Able To Live In Indonesia Sentenced To 2 Years In Prison

JAKARTA - A Yemeni citizen with the initials MHAS was proven guilty of falsifying a marriage certificate to obtain a residence permit in the country. The perpetrator was sentenced to two years and nine months in prison and a fine of Rp. 300 million and a subsidiary of one month in prison.

"In the decision read by the panel of judges at the North Jakarta District Court, MHAS was legally and convincingly proven guilty of violating Article 123 letter (a) of Law Number 6 of 2011 concerning Immigration," said the Head of the Public Relations and General Affairs Division of the Directorate General (DG). ) Immigration Ministry of Law and Human Rights (Kemenkum HAM) Arya Pradhana Anggakara through a written statement quoted by Antara, Friday, November 12.

The Yemeni national was proven to have violated the Immigration Act regarding the provision of false, or falsified or false documents or information with the intention of obtaining a visa or residence permit for himself, said Arya Pradhana Anggakara.

This case began when an immigration officer at the Class I Immigration Office in Central Jakarta was contacted by a member of the Foreigner Monitoring Team (Timpora) at the Yemeni Embassy.

After checking, it was found that MHAS' passport was at the Serang Immigration Office for an application for a status transfer from a family union limited stay permit (ITAS) to a permanent residence permit (ITAP) on 27 October 2020. However, MHAS was also listed in the People's Wanted List (DPO) Sub Directorate General of Immigration Investigation.

"At that time, officers at the Serang Immigration Office were suspicious because the time span for applying for a residence permit was too close to the previous residence permit," he said.

Based on the results of further examination, it is known that the MHAS marriage was not registered in the register of the Office of Religious Affairs (KUA) of Tanjung Priok District, North Jakarta.

There are several irregularities in the marriage book shown by MHAS, including the unregistered registration number listed, the writing is still using hands, and the incompatibility of the KUA stamp and signature of the Head of KUA.

MHAS has been detained in the Immigration Detention Room of the Directorate General of Immigration since April 6, 2021 and his residence permit was canceled on the same day. After the case file was declared complete, MHAS was detained by the prosecutor at the Cipinang Detention Center on August 16, 2021 and the first trial against MHAS was held on September 16, 2021.
