Kejari Garut Releases Lawsuits For HP Thief For Humanity

GARUT - The District Attorney for Garut, West Java, has acquitted the suspect in the case of the theft of a cellphone (HP) for humanitarian reasons and various other considerations, one of which the victim did not feel harmed in that case.

"This (restorative justice) is based on humanitarian considerations. The most important thing is that there is peace between the two parties," said Head of the Garut District Attorney's Office, Neva Devi Susanti, quoted by Antara, Wednesday, November 10.

He said that the suspect, Comara Saeful, 41, a resident of Sakawayana Village, Malangbong District, Garut Regency, stole a cell phone belonging to a student who was carrying out field work practices at the local village office on September 8.

The suspect, said Neva, came to the village office to ask for rationed rice for the poor, then the suspect left the room and saw a cell phone lying on the table and took it.

However, the village office, which was in a state of silence, knew that the perpetrator had stolen the cell phone, so the village called the suspect. The perpetrator admitted that he took a cell phone to study online for his son, who is still in the sixth grade of elementary school.

"Comara was then called and when asked he admitted that he had taken his cell phone and that it was immediately returned," said Neva, accompanied by the Head of the General Criminal Section of the Garut District Attorney's Office, Ariyanto.

Neva said that even though he had handed over the stolen goods, the suspect was still secured to avoid unwanted things by being handed over to the Malangbong Police Station.

The suspect, said Neva, was charged with Article 362 of the Criminal Code concerning theft. Then the Kejari Garut carried out an analysis of the case until finally the termination of the lawsuit could be filed with various considerations and had gone through a consultation process with the West Java Attorney General's Office and the Attorney General's Office.

"It was possible to apply for 'restorative justice' or termination of prosecution," he said.

Neva said that with the approval, the suspect, who had been detained for two months by the Garut Police, was finally released and was able to reunite with his family.

"The suspect was detained for almost two months, so with this the case is over, we will stop it," he said.
