JAKARTA - Musician Fariz RM has come to the Polda Metro Jaya to follow up on a police report regarding the alleged copyright infringement he filed last year.
Accompanied by his lawyer, Deolipa Yumara, Fariz questioned the continuation of the case involving a young musician named Syahravi.
"Today, I and Bang Fariz with the lawyer team, we want to coordinate with investigators at the Ditreskrimsus Polda Metro Jaya regarding Bang Fariz RM's report which has been almost a year. This is about copyright," said Deolipa at the Polda Metro Jaya, Wednesday, June 23.
This report has actually been officially registered since July 2023, but Fariz RM's party chose not to expose it to the public until now.
"A police report has been made and this is in process, so this is a coordination because there was a call from the investigator for coordination of the continuation of this case," added Deolipa.
Fariz RM then explained the essence of the legal problem he was going through.
"The case is a violation of the use of copyright of one song, the title 'Di Antara Kata', which was produced without legal permission related to the use of mechanical rights," said Fariz.
According to the 67-year-old musician, this offense covers the digital realm to the stage of the performance.
"Produced, published as a single on digital platforms and all sorts of forms, distributed without permission. Then also staged without legal permission," he said.
Fariz feels that this report must be continued because the party concerned has not shown good faith even though they have been given a very long time.
"After we reported it, we told them again, and we waited for a year until today. Because it is clear that there is no good faith, that's why we continue this legal process," said Fariz.
The lawyer also said that the accused was suspected of violating the Copyright Law with a fairly heavy punishment.
"The suspicion is copyright infringement. Using a song creation without permission. The threat is many years," said Deolipa.
Fariz also highlighted that his song, which was used by Syahravi without permission, is still freely accessible on various digital music platforms.
"It's still (on the digital platform). We have warned to lower it and all sorts of things, the warning is clear in the summons, but it is not being addressed," he explained again.
Fariz also emphasized that the steps he took this time were for the sake of upholding the rules of HAKI in Indonesia. He invited musicians to use his works, but without harming copyright.
"I said it was okay (to sing), as long as the SOP was in accordance with the legal procedures according to the law and the Law on Intellectual Property Rights (HAKI) that applies in Indonesia," he concluded.
