Local EO Chronology Sues Company Claimed To Be Maher Zain's Deputy Label In Indonesia

JAKARTA - The legal problem occurred due to the cancellation of the concert of Lebanese singers, Maher Zain, which is planned to be held in two cities in Indonesia in 2024.

PT Scheme Kreasi Nusantara, which is engaged in organizing events (EO), filed a default lawsuit at the South Jakarta District Court against PT Aventa Performa Indonesia which is also EO, as well as PT Digital Network Aesthetics (DNA) which claims to be the representative of the Awakening Music label that houses Maher Zain in Indonesia.

PT Scheme's legal team through a broadcast received by VOI on Tuesday, June 24 explained that the lawsuit, which was registered on May 19, stemmed from a Cooperation Agreement (PKS) signed by PT Aventa, PT DNA and PT Scheme on March 14, 2024.

In the agreement, the parties agreed to hold Maher Zain Concerts in Jakarta on August 2, 2024, and Surabaya on August 4, 2024.

In the PKS, DNA is obliged to ensure Maher Zain comes to Indonesia to appear in Jakarta and Surabaya according to the agreement. DNA is also obliged to ensure that the 43-year-old singer performs approximately 16 songs at the concert, and ensures that she attends the first press conference before the concert is held.

Furthermore, the scheme sent Rp294,250,000 and Rp500,000,000 to DNA on March 20, 2024. The total money of Rp794,250,000. is a down payment (DP) from the Scheme for the benefit of financing Maher Zain's Concert in Indonesia.

However, five days after the money was sent, the Scheme received an email notification of the cancellation of the cooperation agreement from Aventa. In its notification, Aventa promised to return the down payment that the Scheme had paid to DNA.

At the cancellation of the concert, Scheme asked Aventa to return the down payment and compensate for a loss of 5% of the total DP or Rp. 39.7 million. The request was also approved by Aventa via email sent on March 27, 2024 and asked for 30 days to return it.

However, it turned out that Aventa had not kept its promise. The scheme also collects on May 15, 2024. However, these efforts never paid off, until the two parties met on May 27, 2024, to discuss the issue of refunds.

Unfortunately, according to Scheme's legal team, Aventa seemed to throw the matter into DNA, explaining that the agreement was actually canceled by DNA.

Aventa also promised to ask DNA to return the down payment that had been issued by the Scheme, considering that the return was a DNA obligation.

The issue of refunding money becomes complicated because DNA does not want to return money. When meeting Scheme on June 10, 2024, DNA reasoned that it would still carry out Maher Zain's concert in Indonesia, and would return the down payment after the concert was completed.

PT Scheme and PT DNA again followed up on the discussion regarding the refund on June 14, 2024. During the meeting, DNA agreed to terminate the initial agreement with Scheme and Aventa. A new agreement related to the schedule for holding Maher Zain's concert in Indonesia was also made.

To ensure that DNA actually carries out Maher Zain's concert, Scheme regularly sends letters as a follow-up to the new agreement, on July 4, August 29, October 9, and November 19, 2024.

Because there was no clarity, PT Scheme then sent a subpoena to DNA on November 28, 2024. The subpoena was then answered by PT DNA through Hamzah Fansyuri Law Office. In the reply letter, DNA asked for the opportunity and flexibility to realize Maher Zain's concert.

Furthermore, on January 20, DNA promised a Scheme for cooperation in organizing the Islamic Music and Culture Festival as a solution to restore the canceled Maher Zain concert DP, but the promise did not materialize until the lawsuit was filed.

Based on VOI's search from the Case Investigation Information System (SIPP) of the South Jakarta District Court, the lawsuit was registered on May 19, with case number 499 / Pdt.G / 2025 / PN JKT.SEL.

The scheme demanding a refund of Rp794,250,000, along with immaterial compensation arising at Rp1,262,480,000.
