JAKARTA - The Ministry of Manpower through the Manpower Supervisory together with the Manpower Supervisor of Central Sulawesi Province has resumed monitoring compliance with the Norms of the Use of Foreign Workers (TKA).
This examination was carried out at PT Wanxiang Nickel Indonesia (WNI), Bahomootefe, Morowali, Central Sulawesi, on September 4, 2025.
The Director of the Manpower Norm Examination at the Ministry of Manpower, Rinaldi Umar, revealed that from the results of the examination, the supervisory team found a number of company non-compliance with the labor regulations.
"The team found 37 foreign workers who worked at PT WNI only used a Special Stay Permit (ITK) without RPTKA, 6 foreign workers with expired visas, and 1 foreign worker who could not show visa documents," said Rinaldi, quoted Monday, September 8.
Furthermore, Rinaldi revealed that the team also found the use of foreign workers with the initials WL which was empowered in the personnel department (HRD), as well as 3 foreign workers who were employed as chefs, even though the position was not in accordance with the ratification of the RPTKA.
"The team also noted that there was a violation of compliance with social security norms in the form of not having registered 5 people in the BPJS Ketenagakerjaan program and BPJS Kesehatan," he continued.
In addition, the company reported that the wages of 65 foreign workers only according to the standards of the Morowali Regency UMP amounting to Rp3,957,673 or below what is stated in the RPTKA, which is US$1,000 per month.
Rinaldi added that the supervisory team also highlighted the lack of mandatory annual reporting of the use of foreign workers to the Ministry of Manpower, the absence of Indonesian workers (TKI) appointed as TKA assistants in the context of technology transfer, and the absence of Indonesian language training programs for foreign workers.
Based on these findings, the supervisory team has taken direct action in the form of a request for a statement from PT WNI to immediately remove 37 foreign workers who do not have RPTKA from the work location.
"Furthermore, the team will issue a written warning, monitor compliance with warnings, coordinate with the Ministry of Immigration for follow-up, and do not rule out the possibility of imposing administrative sanctions on PT WNI," he explained.
