JAKARTA - The government has begun to socialize Government Regulation (PP) Number 28 of 2025 concerning the Implementation of Risk-Based Business Licensing which was issued on June 5, 2025. The regulation revokes the previous regulation, namely PP No. 5 of 2021 concerning the Implementation of Risk-Based Business Licensing.
The regulation requires anyone who wants to open a business on small islands of Indonesia to have a permit from the Ministry of Marine Affairs and Fisheries (KKP).
Director of Coasts and Small Islands of the Directorate General of Marine Management of the KKP Ahmad Aris said there was a significant change to the authority of the KKP in business licensing.
Aris said that the PP provides certainty of trying for business actors, both mechanisms and procedures for business actors. Thus, the regulation provides guarantees for the sustainability of the management of coastal areas and small islands.
"For example, in managing small islands, which initially had the authority of the KKP to provide permits for the use of small islands, they were at the last, called Business Licensing to Support Business Activities (PB UMKU). This means that the position is number three after the basic licensing and new business licensing of the KKP behind," said Aris at a press conference at his office, Wednesday, July 9.
With the issuance of the new regulation, now the authority of the KKP is in its initial position, so that it can provide certainty of the management of small islands in the future. Aris said that in the previous regulation, the use of small islands must have a permit to Approval the Adjustment of Spatial Utilization Activities (PKKPR) from the Ministry of ATR/BPN.
Then, the use of small islands must also have a permit from the Ministry of Environment (LH) and must obtain building approval (PBG).

"After that, then business licensing is based on KBLI. For example mining, KBLI's type of business is like this, if the KBLI agriculture is like this. Then for tourism, resorts, KBLI like this. KKP's position is the last three, namely its position in PB UMKU. So, the last position is like KKP. Now it is withdrawn in the future," he said.
Furthermore, said Aris, obtaining a permit from the KKP is mandatory for all business sectors in small islands, including mines. Even so, he continued, his party must revise the Regulation of the Minister of Marine Affairs and Fisheries (Permen KP) Number 10 of 2024 concerning the Utilization of Small Islands and Waters in the vicinity.
"All sectors. All business activities on small islands are required to have permission and recommendations from the KKP first. We may improve the derivative regulations for Permen KP No. 10 of 2024, so that the process business is appropriate," concluded Aris.
