JAKARTA - The Ministry of Maritime Affairs and Fisheries (KKP) appealed to document holders of the Adjustment of Marine Spatial Utilization Activities (KKPRL) to carry out their obligations to submit annual reports to the Minister of Marine Affairs and Fisheries, or in this case the Director General of Marine and Marine Space Management.
Special Staff to the Minister of Marine Affairs and Fisheries (KP) for Public Relations and Public Communication, Doni Ismanto Darwin, stated that the KKP would impose strict sanctions on KKPRL holders who do not comply with the mandatory reporting regulations every year.
He said the KKP would impose administrative sanctions of IDR 5 million per day on KKPRL holders who ignored these obligations.
Doni explained that sending annual reports is one of the obligations for KKPRL document holders. This has been regulated as stated in the Regulation of the Minister of Marine Affairs and Fisheries (Permen KP) Number 28 of 2021 concerning the Implementation of Marine Spatial Planning.
"We always urge that there are sanctions for those who are late, let alone do not submit reports," Doni said as quoted from his written statement, Monday, April 28.
Meanwhile, the supervision of the arrangement of the sea space that regulates sanctions against KKPRL holders does not fulfill their obligations is also stated in the Minister of Marine Affairs and Fisheries Regulation Number 31 of 2021 concerning the Imposition of Administrative Sanctions in the Marine and Fisheries Sector.
Furthermore, Doni said, that the annual report includes progress in obtaining Environmental Approval and Business Licensing as well as realization of the vast waters and utilization of them in terms of issued Business Licensing.
"This annual report is to see the commitment of KKPRL holders to obligations in the use of marine space, one of which is environmental management and socio-economic responsibility for coastal communities," he said.
Since the last five years, the KKP has issued 2,530 KKPRL documents.
Of the total, 17 of them no longer apply because they have been canceled or revoked, so holders no longer need to report annual reports.
Based on data from the Directorate General of Marine and Fishery Resources Supervision (PSDKP) of the KKP, there are around 739 KKPRL document holders who have not or are late in submitting annual reports.
For information, the delivery of annual reports is carried out every year.
Reporting must not exceed the date of the issuance of KKPRL documents. For example, the KKPRL document is issued on August 24, 2023, so the first annual report must be submitted on August 23, 2024.
Director of Marine Space Utilization Control of the Directorate General of Marine Spatial Planning of the KKP Fajar Kurniawan added that the delivery of annual reports would provide legal certainty for business activities carried out in the sea space.
Referring to the Minister of KP Regulation Number 28 of 2021, the validity period of the KKPRL document is only two years if there is no follow-up in the form of business. As for the validity period, licensing tries to vary, it can be up to 20 years according to the types of business activities.
