Leading The Danantara, Rosan Roeslani And Dony Oskaria Are Advised Not To Multiple Positions

JAKARTA - President Prabowo Subianto has officially launched the Anagata Nusantara Resources Investment Management Agency (BPI Danantara) or Danantara Indonesia.

Prabowo has also appointed Rosan Roeslani as head of Danantara's Chief Executive Officer (CEO), Dony Oskaria as Chief Operating Officer (COO) and Pandu Sjahrir as Danantara's Chief Investment Officer (CIO).

Dantara will be led by Mr. Rosan Roslani, later will be assisted by Mr. Dony Oskaria as the Operational Holding and Mr. Pandu Syahrir who will hold the Investment Holding, Head of the Presidential Communication Office Hasan Nasbi, at the Merdeka Palace, Jakarta, Monday, February 24.

Then, the Danantara Supervisory Board (Dewas) was also appointed directly by the President. Hasan said that the Minister of SOEs, Erick Thohir, was appointed as Chairman of the Council and Muliaman Hadad as Deputy Chair.

"The chairman of the Supervisory Board who has been appointed by the President is Mr. Erick Thohir, and Deputy Chairman of the Supervisory Board Mr. Mulyamman Hadad," said Hasan.

Executive Director of the Center of Economic and Law Studies (Celios) Bhima Yudhistira suggested that ministers who hold concurrent positions should resign and focus on working in the Danantara.

"Regarding the minister, concurrent positions should resign and focus on working in the Danantara," he told VOI, Monday, February 24.

He emphasized that concurrent positions can disrupt concentration, especially considering the many expectations from investors and the public for the existence of the Danantara.

"Do not let concurrent positions interfere with concentration, especially since there are many expectations from investors and the public regarding the presence of the Danantara," he said.

To note, based on Article 23 of Law Number 39 of 2008 concerning the Ministry of State regulates the prohibition of the Minister of concurrent positions. In order to increase professionalism, ministers are prohibited from holding concurrent positions as other state officials, commissioners and directors of companies, and organizational leaders financed from the APBN and/or APBD.

In addition, in the Constitutional Court Decision (MK) Number 80/PUU-XVII/2019 concerning the prohibition of concurrent positions by the Deputy Minister.

Although the Constitutional Court's decision has not been stated in the law, it still has binding legal force and is directly applicable as stipulated in Article 47 of Law no. 24/2003 concerning the Constitutional Court.

Thus, President Prabowo is required to reshuffle the cabinet of the Red and White Cabinet for the second time, after previously inaugurating Brian Yuliarto as Minister of Higher Education, Science and Technology, in replacing Satryo Soemantri Brodjonegoro.
