JAKARTA - The Ministry of Energy and Mineral Resources (ESDM) has issued regulations related to fine rates for mining needs activities carried out in forest areas.

The regulation was issued in the form of a Ministerial Regulation (Permen) of the Ministry of Energy and Mineral Resources (ESDM) Number 391.K/MB.01.MEM.B/2025 concerning the Administrative Fine Tariff for Violating Mining Business Activities in Forest Areas for Nickel, Bauxite, Timah and Coal Commodities. The rules signed by the Minister of Energy and Mineral Resources, Bahlil Lahadalia, have been in effect since December 1, 2025.

"The calculation of the determination of administrative fines for mining activities in forest areas is based on the agreement of the Forest Area Control Task Force for mining business activities," the regulation wrote, quoted on Tuesday, December 9.

Meanwhile, the amount of this tariff is also in accordance with the letter of the Deputy Attorney General for Special Crimes as the Chief Executive of the Forest Area Control Task Force Number B-2992/Set-PKH/11/2025 dated 24 November 2025.

In this regulation, Bahlil set a fine for nickel commodities of Rp. 6.5 billion per hectare, then for the bauxite commodity it was set at Rp. 1.76 billion per hectare.

Meanwhile, the fine for tin commodities was set at IDR 1.25 billion per hectare and finally, coal commodities were pegged at IDR 354 million per hectare.

Later, the collection of administrative fines for mining business activities in forest areas will be carried out by the PKH Task Force for mining business activities and the results of the collection of fines are calculated as Non-Tax State Revenue (PNBP) for the ESDM sector.

"The determination of administrative fines for mining business activities in forest areas applies to the prosecution of violations committed by the Forest Area Control Task Force," the regulation reads.
