Unemployed Land For Two Years Can Be Taken By The State, Minister Of ATR/BPN Disburses The Mechanism

JAKARTA - Whether or not they have activities for two years will be taken over by the state.

Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency (ATR/BPN) Nusron Wahid explained, this is as stated in the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 21 of 2020 concerning Handling and Settlement of Land Cases.

"Based on Ministerial Regulation Number 21 of 2020 concerning abandoned land that states this, state land or land in the form of Cultivation Rights (HGU) and Building Use Rights (HGB) after two years of being given their rights by the state, then that is included in the evaluation stage, what evaluation? Is the land being carried out or not, used or not, used or not," said Nusron after inaugurating the 2025 Community Budgeting Movement (Gemapatas) in Purworejo Regency, Central Java, as monitored online via YouTube Ministry of ATR/BPN, Thursday, August 7th.

"The nature of the HGU and HGB, is not inherited land," he continued.

If the land is inherited land, Nusron ensures that it will not be taken by the state. The reason, he said, is that the inheritance area is relatively small, ranging from 20-30 meters.

"If the inherited land is only 20 or 30 meters, it will not become this object," he said.

Nusron also explained the mechanism. First of all, the government will provide a letter of warning regarding the potential for abandoned land. The first warning is related to the potential for abandoned land to be given 180 days.

"The notification was 180 days. After 180 days, the person concerned was still stubborn and did nothing more, given the first warning letter," he explained.

After that, said Nusron, a second warning was given for 90 days and was evaluated for two weeks.

"If you are still stubborn, there are no developments, you will be given a third warning (for) 30 days. Still stubborn, evaluated, determined to be abandoned land," said Nusron.

Later, the abandoned land will be used and utilized by other people in need, especially the small people who do not yet have land.

"Don't let one side there be people who don't have land, want to plant cassava is difficult. There are thousands of hectares of land, but it's postponed. It's not allowed," he explained.

Thus, Nusron continued, the deadline from notification to determination of abandoned land reached 587 days.

According to him, the deadline must be used by the land owner to use the land.

"So, the government in determining abandoned land which can then be taken over by the country does not necessarily exist, there is a process," said Nusron.

"Including, the land of small people is impossible to take. Because if the land is small people, let alone land 1,000 meters, 200 meters or 300 meters will definitely be used," he concluded.
