The Head of the Bakal Ajukan Ponpes will file a preliminary trial for the suspect in the burning of the students in the attic.

JAKARTA - The head of the pesantren with the initials MR (55) through his lawyer stated that he was ready to file a pretrial lawsuit against the steps of the Central Lombok Police (Loteng) in determining the suspects in the burning of students.

"We will immediately apply for a pretrial application to test the validity of the determination of suspects made by investigators," said MR's lawyer, Muhammad Ikhwan in Mataram, Friday, July 10, reported by ANTARA.

According to the lawyer for MR, who also acts as the Chairman of the Legal Aid Institution Nahdlatul Wathan (NW), his party did not see any intentional element until the incident that resulted in one of the three students dying.

"In fact, according to us, there is no element of error that can be charged to our client. Instead, this event is a disaster that no one wants," he said.

He explained that his client knew about the fire incident which resulted in a number of students becoming victims after the incident.

Therefore, according to him, it is very inappropriate if his client is held criminally responsible on the basis of negligence which is claimed to be the cause of the incident.

"If the investigators infer negligence, then what is meant is certainly related to the actions or failure to take action by our client after the incident occurred," he said.

"In fact, negligence that can be held criminally responsible is negligence that has a direct causal relationship with the occurrence of a criminal act," he said.

He also assessed that the determination of the suspect MR was premature and was not supported by sufficient evidence to prove the element of negligence as suspected by the investigators.

Iwan argues that the events that occurred in December 2025 were accidents, not acts committed intentionally or as a result of his client's negligence.

Therefore, he stated that the step of the investigators to name his client as a suspect was a form of criminalization because it did not have a strong legal basis.

Furthermore, Iwan revealed that his client is currently in the process of recovering from his health after undergoing inpatient treatment at the hospital.
