JAKARTA - The Central Leadership Council (DPP) of the Moon Star Party (PBB) officially filed a lawsuit against the Political Party Law to the Constitutional Court (MK). This lawsuit highlights the authority of the Minister of Law in approving the management of the party which is considered vulnerable to abuse.
"We convey that the Central Leadership Council of the National Party has submitted a request for judicial review to the Constitutional Court," said the Chairman of the PBB General Assembly, Bali Gugum Ridho Putra, to reporters quoted on Tuesday, April 21.
Gugum said there were two laws that were sued for material testing, namely Law Number 2 of 2008 and Law Number 2 of 2011 concerning Political Parties. This lawsuit was triggered by internal conflicts in the PBB after the VI Congress in Bali.
According to Gugum, his party first submitted the approval of the management to the Ministry of Law since March 9, 2026. However, three days later, a counter-application from another party based on the Party Council Meeting (MDP) emerged.
"Administratively, legally, the party who submits it first, legally, the public, must be given priority, first come first serve, he is the one who should be served and given a decision letter of approval," he explained.
He emphasized that the management of the results of the VI Congress was valid in terms of organization, in contrast to the results of the MDP which were considered defective in procedure. "The organizer is not valid because it was carried out by the Regional Leadership Council, not the Central Leadership Council," said Gugum.
In the midst of this controversy, Gugum heard the news that the Minister of Law had issued a confirmation of the management results of the MDP. Thus, the UN asked the Constitutional Court to limit or even revoke the authority.
Because, this authority has the potential to be a gateway for intervention in internal party conflicts. "So today we came to the Constitutional Court in order to test the authority of the secretary of state to ratify this," he said.
"We ask the Constitutional Court to cancel the authority of the ratification and limit it only to recording the legal events of political parties. So, we ask the Constitutional Court to ask the minister of law to be enough as a recorder of legal events only," he added.
In addition, the UN also asked the Constitutional Court to take over the resolution of the dispute over the dualism of management, which has been considered failed to be resolved by the party court.
"From this opportunity we ask that the dispute over the dualism of party management be taken over by the Constitutional Court. Because as a court that is capable and has the capacity to do that, only the Constitutional Court today can try disputes related to political parties," said Gugum.
Meanwhile, the Secretary General of the PBB DPP, the result of the VI Bali Ali Amran Tanjung Muktamar, assessed that this step was taken to strengthen the legal system and prevent internal conflicts from damaging the legitimacy of the government.
"Therefore, it is very important to have a strong system, a strong constitution, strong provisions, which do not give room to anyone to exceed the limits of their authority in the internal settlement of political parties," he concluded.
