JAKARTA - Deputy Chairman of Commission X of the Indonesian House of Representatives, MY Esti Wijayanti, asked the University of Indonesia (UI) to give a firm sanction to dozens of students who were perpetrators of chats that led to sexual harassment in a chat group. He also encouraged the completion of the case to be carried out using the TPKS Law.
"We regret the sexual harassment incident that occurred at the Faculty of Law (FH) UI. We urge the campus to give firm testimony to those who do it," said MY Esti Wijayanti, Wednesday, April 15.
Esti encourages that the imposition of sanctions does not stop only in the internal campus realm, considering that there are many victims of the perpetrator's actions.
"Legal intervention is needed so that there is a deterrent effect for the victims, and the parties who are harmed by this case," he said.
Esti assessed that the case of harassment that occurred at FH UI needed to be handled with legal products that Indonesia had in dealing with cases of sexual violence, namely Law Number 12 of 2022 concerning Sexual Violence Crimes (TPKS Law). According to him, what the perpetrators did had fulfilled the elements of the type of sexual violence contained in the TPKS Law.
"And the perpetrators themselves are law students who should be more sensitive and understand every legal consequence," said Esti.
It is known that in the TPKS Law, types of sexual violence are categorized by several types of actions. One of them is electronic-based sexual violence with a maximum imprisonment of 4-6 years and/or a maximum fine of Rp. 200-300 million. Therefore, Esti encourages victims to report this case to the criminal realm.
"With the imposition of strict sanctions in accordance with the TPKS Law, we hope that all people, especially in the academic environment, will not allow the incident to happen again," he said.
"And the most important thing is that no one normalizes any action that leads to sexual violence," continued Esti.
Furthermore, Esti appreciated UI which immediately carried out the investigation process in the case of alleged sexual harassment in a chat group through the Sexual Violence Prevention and Handling Task Force (Satgas PPKS). He reminded UI to prioritize the principle of confidentiality for victims.
"And handling cases must be carried out fairly. And there needs to be support for victims. Both psychological, legal, and academic support so that victims who have experienced trauma can recover immediately," he concluded.
