Jakbar Mayor's Office, Kalideres Crematorium Project Trial Postponed

JAKARTA - The first trial of the State Administrative Court (PTUN) lawsuit filed by residents regarding the construction project of the Swarga Abadi Funeral Home and Crematorium in Kalideres was postponed because the West Jakarta City Government (Pemkot Jakbar) was not present in the trial.

Coordinator of Citra Garden 2 Residents, Budiman Tandiono said that the West Jakarta City Government (Jakbar) had not given any reason for his absence at the Jakarta PTUN.

"Both the defendant directly and the legal representative. Then a summons will be given back to the defendant," said Budiman when confirmed in Jakarta, Wednesday, quoted by Antara.

Budiman explained that the agenda for today's hearing was still at the initial stage of the trial, namely the examination of the file and the administration of the lawsuit filed by residents as plaintiffs.

"Today's trial should be a preparatory examination trial where the single judge examines our case file from the power of attorney and the lawsuit," he said.

Due to the absence of the defendant and the existence of a number of administrative evaluation notes from the panel of judges, the trial must finally be postponed until March 31, 2026.

The judge also asked the residents to complete and improve several power of attorney and lawsuit documents.

"Later on March 31, the agenda is still the same, the preparation examination. This preparation examination session has a time limit of 30 days according to the TUN (State Administrative Procedures) law," he said.

He also hopes that the trial will run smoothly and the demands of the residents can be met by the Jakbar City Government (Pemkot).

"Our hope is that in the future, during the preparation examination, the defendant can attend the trial and we all hope that the defendant can immediately revoke the SK PBG Yayasan Rumah Swarga Abadi so that the construction of the crematorium can be stopped completely," he said.

Residents of Kalideres sued the Mayor of West Jakarta, Iin Mutmainnah to the Jakarta PTUN for granting the Building Approval (PBG) permit for the construction project of the Swarga Abadi Crematorium on Jalan Utan Jati.

Coordinator of Citra Garden 2 Residents, Budiman Tandiono said, the lawsuit with case number 83/G/2026/PTUN JKT was filed because residents considered the granting of the crematorium permit to be in violation of the local regulation (perda).

"The Mayor of West Jakarta Administration cq Head of the Integrated Investment and Service Unit (PM-PTSP) of West Jakarta City was arrested," said Budiman when confirmed in Jakarta, last week.

The legal steps, he said, had been taken since last week and had now been officially registered at the Court.

"Yes, yesterday we residents of Kalideres and Pegadungan rejected the construction of a funeral home and crematorium, we have registered a lawsuit to the PTUN for the granting of the project permit," he said.
