Banten Police Deny Ojol Driver who was a Victim to the Death of Passengers as a Suspect

Banten Police confirmed that there was no determination of a suspect for the driver of an ojek with the initials MA in a traffic accident on the Pandeglang-Labuan Highway, Pandeglang Regency, on January 27, 2026, which resulted in the death of the ojek passenger.

Head of Public Relations of the Banten Police, Kombes Maruli Ahiles Hutapea, said the case was still under investigation by the Pandeglang Police Traffic Unit.

"It needs to be known by all colleagues until today, this afternoon, the Pandeglang Police Satlantas investigators are still investigating this case with the status of the case in the investigation stage. So it is certain that there has been no determination of suspects as the news circulating," said Maruli in Serang City, Monday, February 23, reported by ANTARA.

He explained that the accident occurred on Friday (20/2) at 12.30 WIB in Gardu Tanjak Village, Pandeglang Village, Pandeglang District.

The vehicles involved were a Suzuki XL7 village ambulance car driven by BP and a Honda Revo motorcycle driven by MA with KR passengers.

According to him, both vehicles were traveling from Pandeglang to Labuan. At the location, the motorcycle allegedly fell into a hole so that the rider lost control.

"The motorcycle tire entered the hole so that the person using the motorcycle in front lost control, then fell. Then the motorcycle passenger, brother KR, bounced to the right, then went into the undercarriage of the village standby car that passed by the motorcycle," he said.

This resulted in the head of the motorcycle passenger being hit by the left rear tire of the village standby car.

As a result of the incident, the passenger died on the spot, while the driver was injured and evacuated to Berkah Pandeglang Hospital.

Maruli added that a police report had been received from the victim's family and investigators were still collecting evidence and witness statements.

"So, there are no suspects, it's still in the investigation stage. We will later collect evidence from the Pandeglang Police Traffic Unit, find witnesses who saw, knew, heard about this incident. That material will be used to file a case," he said.

Head of the Pandeglang Police Traffic Unit, Deputy Commissioner of Police Burhanudin Surya Muhammad, emphasized that his party was still collecting evidence to conduct a case study.

"As has been conveyed, at this time it is still under investigation, so there has been no determination of suspects. For now we are still collecting evidence and then later we will carry out a case title at the level of the Police," he said.

Meanwhile, Pandeglang Police Chief of Police Ipda Toni Sumartanto ensured that internal supervision was also carried out for handling the case.

His party is also willing to facilitate between the victim's family and the motorcycle taxi driver if later the restorative justice path will be taken.

Status of the suspect

Previously, the motorcycle taxi driver with the initials MA was reported to have been a suspect based on the police report Number LP/B/21/I/2026/SPKT/Lantas Pandeglang Police for a traffic accident that caused his passenger, KR, to die, according to MA's lawyer, Raden Elang Mulyana.

Raden explained that his client tried to avoid the first pothole, but his motorcycle hit the second road hole, which caused the motorcycle to wobble.

At the same time, from behind, a Suzuki XL7 car in metallic white with the police number A 1255 Z driven by Bayu Prayoga was speeding. The collision from behind was unavoidable.

As a result of the incident, Khairi Rafi died at the scene. Meanwhile, Al Amin suffered injuries to his face, head, hands, and feet. The motorcycle he was riding was also heavily damaged.

Raden also revealed that his client sued the Pandeglang Regent Raden Dewi Setiani and the Banten Governor Andra Soni and his staff. The lawsuit was registered through the Pandeglang District Court e-court on Sunday, February 22, 2026.

Raden said that although the traffic accident suffered by his client was considered serious, it did not happen because of his client's negligence, but due to the condition of the road which was potholed.

He revealed that the lawsuit was made in reference to Article 236 and Article 240 of the Road Traffic and Transportation Law, which also regulates the right of accident victims to obtain compensation from the party responsible for road maintenance.

Meanwhile, the Pandeglang Police Satlantas Gakkum Unit Head, Ipda Sofyan Sopanmengatakan, the determination of the suspect against MA was made because there was an alleged element of negligence in driving which caused the passengers to lose their lives.

Sofyan said that initially the incident was a motorcycle negligence and was beyond the ability of the ambulance driver because the vehicles were lined up.

When the victim fell, he continued, the ambulance driver had tried to avoid, but the victim was still hit by the back wheel of the ambulance.

In addition, it was explained by Sofyan, as a motorcycle taxi driver, Amin has a responsibility for the safety of his passengers, including providing helmets for passengers and being required to remain concentrated while driving.
