Investigation of the alleged TPPU in the MXGP Samota Circuit Corruption Case, NTB Prosecutor's Office involves PPATK

JAKARTA - The West Nusa Tenggara (NTB) High Prosecutor's Office (Kejati) has partnered with the Financial Transaction Reporting and Analysis Center (PPATK) to trace the Money Laundering Criminal Act (TPPU) case for the procurement of 70 hectares of land for the construction of the MXGP Circuit in the Samota area, Sumbawa Regency.

The Assistant Special Criminal Attorney of the NTB Prosecutor's Office, Muh. Zulkifli Said, confirmed that there was a legal step in handling the TPPU which was in the investigation stage.

"Yes, it's true, there is a PPATK inspection activity in the case of the procurement of the Samota MXGP land in the NTB Prosecutor's Office today," he said in Mataram, Tuesday, quoted by Antara.

Apart from the examination by PPATK, Zulkifli Said confirmed that there was an activity by the NTB Attorney General's investigators who also examined two suspects in the land procurement case, namely Subhan alias SBHN and Muhammad Julkarnaen alias MJ.

The Prosecutor's Office said that Subhan, who is currently serving as the Head of BPN Central Lombok, in this case played the role of the head of the land procurement implementation when he was the Head of BPN Sumbawa. Meanwhile, Muhammad Julkarnaen as the assessment team from the private sector who came from the KJPP.

In the determination of suspects based on the results of the case, the prosecutor determined the two by applying the punishment in accordance with the new Criminal Code regarding corruption.

The criminal is listed in Article 603 and/or Article 604 in conjunction with Article 20 letter c of Law Number 1 of 2023 concerning the Criminal Code.

Head of the NTB Prosecutor's Office Wahyudi at a press conference on Monday (19/1), said that the handling of the TPPU from the corruption case of land procurement for the Samota MXGP Circuit was already in the investigation stage.

"In this case, the investigators also smelled something else, namely TPPU. It has been investigated," said the NTB Kajati during the momentum of returning state financial losses worth Rp. 6.7 billion from Moch. Ali Bin Dachlan alias Ali BD as the recipient of land payments from the Sumbawa Regency Government.

He ensured that the investigation of the TPPU was based on the development of the main criminal case of corruption in land purchases.

"So, the investigators see other criminal acts, that's why it was developed in that direction (TPPU)," he said.

Ali BD, the former Regent of East Lombok is the owner of 70 hectares of land in the Samota area which was purchased by the Sumbawa Regency Government for the construction of the Samota MXGP Circuit in the 2022-2023 budget year.

He returned Rp6.7 billion to the prosecutor because he was declared as a party who enjoyed state financial losses due to excess land payments based on the results of the audit of the NTB Representative of the Financial and Development Supervisory Agency (BPKP).

The government made payments for the land owned by Ali BD and his heirs, departing from the Decree of the Governor of NTB, which was then held by Zulkieflimansyah.

The government purchased the land at a price of Rp52 billion according to the second appraisal result from the Public Appraisal Service Office (KJPP).

Previously, the prosecutor's office stated that the state's financial losses in this case arose from the difference in the results of the appraisal team's assessment from the KJPP.

The Prosecutor's Office explained that the results of the first appraisal, the value of land measuring 70 hectares located in the Samota tourist area, Sumbawa Regency, reached Rp. 44.8 billion.

Then, the second appraisal result appeared for the follow-up of the appeal decision from a civil lawsuit that won a person named Sangka Suci for the claim of ownership of a portion of Ali BD's land. The second appraisal result also appeared with a value of Rp52 billion.

The civil judgment continued to the cassation level at the Supreme Court which stated that Sangka Suci's claim for part of the land was not proven.

Despite the ruling which has become legally binding or Inkrah, the Sumbawa Regency Government still executed the payment of 70 hectares of land to Ali BD with a value of Rp. 52 billion.
