BANDA ACEH - The public prosecutor of the Bener Meriah District Attorney's Office (Kejari), Aceh, has demanded the former Head of the Bener Meriah Regency Forestry and Plantation Service (Kadis) who was a defendant in the tobacco development corruption with a sentence of 2.5 years or two years and six months in prison.

The demand was read by Public Prosecutor (JPU) Asmadi Syam during the trial at the Corruption Crime Court at the Banda Aceh District Court in Banda Aceh, Monday, December 22.

The trial with a panel of judges was chaired by Saptika Handhini and was accompanied by Ani Hartati and M Arief Hamdani as members of the panel.

In addition, the JPU also demanded that the defendant Usman pay compensation for state losses of IDR 139.48 million with the provision that if he did not pay, he would be sentenced to one year and six months in prison.

The JPU stated that the two defendants were proven to be legally guilty of violating Article 3 jo Article 18 of Law Number 31 of 1999 as amended into Law Number 20 of 2001 concerning eradication of corruption as amended by Article 55 Paragraph (1) of the Criminal Code.

Based on the facts at the trial, said the JPU, the Bener Meriah Regency Forestry and Plantation Service in 2013 managed a budget for tobacco development sourced from the tobacco tax revenue (DBHCHT) budget of Rp581.7 million.

The budget is used for a number of activities, including the procurement of tobacco seeds, the procurement of tobacco knives, the procurement of drying mats, the procurement of baskets, the socialization of the impact of smoking, comparative studies, and others.

The activities, said the JPU, were carried out by the companies CV Makmur Jaya and CV Citra Pesangan. However, in its implementation, some activities were not carried out. Meanwhile, the fixed budget was disbursed.

"Based on the results of the audit of the Aceh Representative of the Financial and Development Supervisory Agency (BPKP), the tobacco development activities caused a state loss of Rp. 443.4 million," said the prosecutor.
