JAKARTA - The National Police Reform Acceleration Commission (KPRP) confirmed that there were no new assignments for members of the Indonesian National Police (Polri) outside the police organizational structure after the issuance of Constitutional Court (MK) Decision Number 114/PUU-XXIII/2025.
The confirmation was made by the Chairman of the National Police Reform Acceleration Commission, Jimly Asshiddiqie, after receiving an explanation from the National Police Chief, General Listyo Sigit Prabowo, and the Deputy National Police Commissioner, General Police Commissioner Dedi Prasetyo.
"That has been conveyed by the National Police Chief and also by the Deputy National Police Chief. There are no new appointments. In fact, after the Supreme Court's decision, there will be no new assignments, while waiting for more certain rules in the future," said Jimly in his statement, Thursday, December 18.
Jimly explained, the Regulation of the National Police of the Republic of Indonesia (Perpol) Number 10 of 2025 concerning Police Officers who Carry Out Tasks Outside the Structure of the National Police Organization was actually issued to implement the Constitutional Court's decision, especially in regulating Police officers who have previously occupied positions outside the police structure.
However, Jimly admitted that there were still problems in the regulation, especially regarding the clarity of the type of position that the members of the National Police could occupy and the latest legal reference after the decision of the Constitutional Court. This condition, according to him, can cause differences in interpretation in the community.
"Often in considering regulations, not all decisions of the Constitutional Court are listed. As a result, it seems as if you are still referring to old laws. This can be interpreted as opposing the decision of the Constitutional Court, although administrative errors like this are common in many ministries," said Jimly.
Therefore, the National Police Reform Acceleration Commission proposes that the government use the omnibus law mechanism in drafting revisions to laws and government regulations (PP) to comprehensively regulate the assignment of members of the National Police to ministries and agencies.
Previously, the National Police Chief, General Listyo Sigit Prabowo, signed Police Regulation Number 10 of 2025 which regulates the assignment of members of the National Police outside the police structure, including in 17 ministries and agencies. Among them are the Coordinating Ministry for Political and Security Affairs, the Ministry of Energy and Mineral Resources, the Ministry of Law, the Ministry of Immigration and Corrections, the Ministry of Forestry, the Ministry of Maritime Affairs and Fisheries, the Ministry of Transportation, the Ministry of Protection of Indonesian Migrant Workers, and the Ministry of Agrarian and Spatial Planning/National Land Agency.
In addition, the Perpol also regulates the assignment of members of the National Police in a number of state institutions, such as the National Resilience Agency, the Financial Services Authority, the Financial Transaction Reporting and Analysis Center, the National Narcotics Agency, the National Counterterrorism Agency, the National Intelligence Agency, the National Cyber and Sandi Agency, to the Corruption Eradication Commission.
"That is precisely to carry out the Supreme Court's decision, while regulating those who have already occupied the position," he said.
