Perpol 10/2025 Controversy: FPI Raya Says Police Chief Upholds the Constitution

JAKARTA - Public debates, experts and legal observers related to the decision of the Constitutional Court Number 114/PUU-XXIII/2025) and Perpol Number 10 of 2025 have become digital pollution in social media spaces to mainstream media. The debate has emerged pro and contra parties, including members of the National Police Reform Committee, Prof Mahfud MD who is also a former Constitutional Court Judge.

The Chairman of the Indonesian Youth Front Raya assessed that Fauzan Ohorella saw that the Police Regulation (Perpol) 10/2025 was a form of legitimacy of the Constitutional Court's decision No. 114 regarding the assignment of active police officers outside the police structure, which was previously considered to have ambiguities in the implementation of Article 28 paragraph (3) of Law No. 2 of 2002 regarding the explanation of assignment from the National Police Chief.

"We see that Perpol is General Sigit's attitude of obedience to the Constitution. Because the MKRI 114 ruling aims to eliminate ambiguity in Article 28 (3) of Law No. 2 of 2002," said Fauzan Ohorella, December 17.

Fauzan, who is also a legal science enthusiast, considers that the Perpol confirms the assignment of members of the police in 17 ministries or agencies, in accordance with the tupoksi and competence of members of the police.

"I think Perpol also provides an internal mechanism for how assignments are carried out, including competence requirements, official requests from agencies, and the approval of related parties." He said.

In addition, he also considered that the concentration of the Supreme Court's decision was the absence of confusing phrases for the public. Fauzan also said that Perpol 10/2025 is the same as Law No. 3 of 2025 concerning the status and coordination of TNI members.

"For me, this Constitutional Court ruling must be a spirit in straightening out policies or rules that confuse the public, and must be far from politicization that can mislead our understanding of all of us." He said.
