JPU Calls 3 Defendants in the Chromebook Koripsi Case to Damage the State Rp2.1 Trillion

JAKARTA - Three defendants in the alleged corruption case of the education digitization program in the form of the procurement of Chromebook laptops and Chrome Device Management (CDM) in the Ministry of Education, Culture, Research, and Technology in 2019-2022 are suspected of causing losses to the state treasury worth Rp. 2.18 trillion.

The three defendants, namely the Technology Consultant of the Ministry of Education and Culture, Ibrahim Arief alias Ibam; Director of Elementary School (SD) at the Directorate General of Early Childhood Education, Basic Education, and Secondary Education of the Ministry of Education and Culture in 2020-2021, Sri Wahyuningsih; and the Director of Junior High School (SMP) at the Directorate General of Early Childhood Education, Basic Education, and Secondary Education of the Ministry of Education and Culture in 2020-2021, Mulyatsyah.

"The defendants have committed acts against the law by enriching themselves or others or a corporation to the detriment of state finances worth Rp. 2.18 trillion," said the public prosecutor (JPU) from the Attorney General's Office, Roy Riady, at the reading of the indictment at the Corruption Court at the Central Jakarta District Court, Tuesday.

The JPU detailed the state's losses, including Rp1.56 trillion related to the education digitization program at the Ministry of Education and Culture, as well as 44.05 million US dollars or the equivalent of Rp621.39 billion due to the procurement of CDM that is not necessary and not useful in the education digitization program.

It is stated that the three defendants committed this illegal act together with the Minister of Education, Culture, Research, and Technology for the period 2019-2024 Nadiem Anwar Makarim and former Special Staff to the Minister of Education and Culture Jurist Tan.

For their actions, the three defendants are threatened with criminal penalties as stipulated in Article 2 paragraph (1) or Article 3 in conjunction with Article 18 of Law (UU) Number 31 of 1999 concerning the Eradication of Corruption as amended and supplemented by Law Number 20 of 2001 jo. Article 55 paragraph (1) of the Criminal Code.

The JPU explained that the illegal acts committed by the defendants included working together with Nadiem and Jurist to procure learning facilities based on information and communication technology in the form of Chromebook laptops and CDM in the 2020, 2021, and 2022 budget years which were not in accordance with procurement planning and various procurement principles.

Then, Nadiem, through Ibam, Mulyatsyah, Sri, and Jurist, made a review of the study and analysis of the needs for information and communication technology (ICT) equipment in the education digitization program, which led to a Chromebook laptop using the Chrome operating system (Chrome OS) and CDM.

"However, the review of studies and analysis of needs is not based on the identification of basic and secondary education needs in Indonesia, so it has failed, especially in the 3T areas (outermost, lagging, leading)," said the JPU.

The JPU added that the defendants, together with Nadiem and Jurist, had also drafted unit prices and budget allocations for 2020 without being accompanied by surveys with verifiable supporting data.

The preparation of unit prices and budget allocation is carried out in the budgeting of the procurement of Chromebook laptops that use the Chrome operating system (Chrome OS) and CDM which is the reference in the preparation of unit prices and budget allocation in 2021 and 2022.

In addition, the defendants, together with Nadiem and Jurist, are also suspected of procuring Chromebook laptops at the Ministry of Education and Culture through e-Catalogs and the School Procurement Information System (SIPLah) application in 2020, 2021, and 2022 without going through the evaluation of the price of the Chromebook laptop procurement and not supported by price references.
