JAKARTA - The Honorary Council of the Constitutional Court (MKMK) decided that in the context of ethical enforcement, Constitutional Justice Arsul Sani was not proven to have falsified his doctoral education diploma as was the issue that recently surfaced.

The verdict was pronounced at a hearing in Jakarta, Thursday, after the MKMK held a clarification meeting on October 20, 2025 following the findings registered by the MKMK Secretariat on November 7.

"The alleged judge (Arsul Sani) was not proven to have violated the Code of Ethics and Conduct of Constitutional Justices as stated in the principle of integrity in the Sapta Karsa Hutama," said Chief Justice of the Constitutional Court I Dewa Gede Palguna, seen from the official website of the Constitutional Court as reported by ANTARA, Thursday, December 11.

In considering the law and ethics of the decision, MKMK Secretary Ridwan Mansyur said the MKMK did not have the capacity to assess and decide the validity and authenticity of Arsul Sani's doctoral diploma.

However, he stated that it is undeniable that the validity of the doctoral degree education diploma is part of one of the decisive elements in assessing whether the judge concerned violates Sapta Karsa Hutama or not.

Therefore, he emphasized that the MKMK is not examining cases by measuring based on the elements of document forgery offenses, as regulated by the Criminal Code.

However, said Ridwan, MKMK can "borrow" the size of the offenses for falsifying documents in criminal law to determine whether Arsul Sani's actions as an alleged judge can be categorized as a disgraceful act that violates ethics.

During the examination of the findings, the Constitutional Court asked Arsul Sani to show his diploma documents before the assembly at the hearing on Wednesday (12/11).

Ridwan added that Arsul was present with the requested documents and showed them to the Honorary Council.

The Constitutional Court stated that it does not have the resources and capabilities to assess the authenticity of a document. However, the intention and attitude of the alleged judge who allowed other parties to see and observe the diploma documents was assessed by the panel as a positive sign.

In addition, the MKMK highlighted the open attitude that Arsul also showed to the public through a press conference on Monday (17/11).

Arsul described the chronology of his doctoral studies and showed his diploma in front of the press.

The MKMK also considered Arsul Sani's statement attending the graduation ceremony held at his campus, Collagium Humanum Warsaw Management University, in Warsaw, Poland, in March 2023.

"That the diploma document as proof of the graduation of the doctoral education of the alleged judge given by Colligium Humanum is an authentic / original document. In other words, from the perspective of the diploma document as the object of the problem, the Honorary Council did not find any falsification of documents in the form of a doctoral education diploma carried out by the suspect judge or the actions of the alleged judge who used fake documents, as if they were genuine / hajati to fulfill the requirements in running for constitutional judge," said Ridwan.

On the other hand, MKMK member Yuliandri explained that his party found the fact that during the doctoral education process, Arsul had submitted his dissertation research.

The Honorary Council also found evidence of a correspondence of guidance through Arsul and his supervisors.

"The Honorary Assembly did not find enough evidence to doubt the research process carried out by the suspect judge in order to meet the graduation requirements for a doctorate from the Collagium Humanum that he had done properly and properly," said Yuliandri.

Based on these facts and considerations, the Constitutional Court concluded that in the context of the enforcement of Sapta Karsa Hutama, Arsul Sani was not proven to have committed acts that were suspected of violating ethics related to falsification of doctoral diploma documents in fulfilling one of the requirements as a constitutional judge.
