JAKARTA - Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency (ATR/BPN), Nusron Wahid, stated that his party had sent an official letter to the Makassar District Court (PN) regarding the order to execute an area of 13.6 hectares in the Jalan Metro Tanjung Bunga area, Makassar, South Sulawesi. The land is known to be the object of the dispute.
According to Nusron, the disputed land belongs to the families of the 10th and 12th Vice Presidents of the Republic of Indonesia, Jusuf Kalla (JK), not to PT Gowa Makassar Tourism Development (GMTD), which is part of the Lippo Group.
"There has never been a dispute between PT Hadji Kalla and GMTD. The existing legal issues are actually between GMTD and other parties, but coincidentally the object is the same," said Nusron, Thursday, November 6.
Nusron explained that the ATR/BPN through the South Sulawesi Regional Office had sent a letter to the Makassar District Court asking for clarification on the order of the execution. He assessed that the execution process carried out by the court was not in accordance with applicable legal provisions.
"We questioned the basis for its execution. In the regulation of the Supreme Court, the execution must begin with a constatering or matching of the facts on the ground. But the Makassar District Court has sent contatering invitations three times and all of them have been canceled, then suddenly it turns into execution. This is not true," he said.
According to Nusron, the invitation to the congress was scheduled for 17 and 23 October 2025, then it was submitted again on 3 November 2025, but has never been implemented. He assessed that the court's sudden steps to issue an execution order without contaminating violated procedures.
In addition, he revealed that factually on the land there were rights to other legitimate land in the name of Hadji Kalla, and the certificates were even issued earlier than certificates owned by GMTD.
If the Hadji Kalla certificate was issued first, mediation should have been carried out first. It can't just be executed right away," he said.
Furthermore, Nusron acknowledged that there was an administrative error within the BPN. He said there were individuals who issued two certificates on the same land object.
"I admit that there was an error from the BPN. Why did two certificates for the same land appear? This is clearly not true," he said.
To resolve the issue, Nusron ensured that ATR/BPN would carry out a legal due diligence thoroughly to determine which certificates were valid.
"We will check everything legally. If there are certificates that are proven not true, one of them will be canceled," he said.
