4 Company Officials Sued For 4 Years In Prison For 2015-2016 Ministry Of Trade's Sugar Import Case

JAKARTA - As many as four high-ranking private sugar companies were sentenced to imprisonment for 4 years each related to the alleged corruption case of sugar importation at the Ministry of Trade (Kemendag) in 2015 2016.

The four defendants are referred to, namely the President Director of PT Andalan Furnindo Wisnu Hendraningrat, President Director (Managing Director) of PT Medan Sugar Industry Indra Suryaningrat, President Director of PT Sentra Usahatama Jaya Hansen Setiawan, and President Director of PT Kebun Tebu Mas Ali Sandjaja Boedidarmo.

"We demand the panel of judges to declare the defendants legally and convincingly proven guilty of committing a criminal act of corruption that was carried out together," said the public prosecutor (JPU) of the Attorney General's Office (AGO) Andi Setyawan in a trial reading the indictment at the Corruption Court at the Central Jakarta District Court, Monday, confiscated by Antara.

In addition to imprisonment, the four defendants were also demanded to be subject to a fine of Rp. 500 million each, provided that if the fine was not paid, it would be replaced (subsider) with imprisonment for 6 months.

The four were also required to be subject to additional penalties in the form of payment of replacement money, with details of Wisnu amounting to Rp60.99 billion, subsidiary to 2 years in prison, taking into account the assets or money belonging to Wisnu which had been confiscated in the amount of replacement money.

Then, Indra was required to pay a replacement money of IDR 77.21 billion, a subsidiary of 2 years in prison, taking into account Indra's assets or money that had been confiscated in the amount of replacement money.

The prosecutor continued, Hansen was required to pay a replacement money of Rp41.38 billion, a subsidiary of 2 years in prison, taking into account Hansen's assets or money that had been confiscated in the amount of replacement money.

Then, Ali was required to pay a replacement money of Rp47.87 billion, a subsidiary of 2 years in prison, taking into account Ali's assets or money that had been confiscated in the amount of replacement money.

For their actions, the four defendants were charged with violating Article 2 paragraph (1) in conjunction with Article 18 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended and supplemented by Law Number 20 of 2001 jo. Article 55 paragraph (1) 1st of the Criminal Code.

Before filing the charges, the Public Prosecutor considered the actions of the defendants who did not support the government's program in the context of organizing a clean and free state from corruption, collusion and nepotism (KKN) as a weighting reason.

Meanwhile, the consideration of mitigating the charges, namely that the defendants had never been convicted, were polite at trial, felt guilty and regretted their actions, and had good intentions to return the money from the corruption in the case.

In that case, the four defendants allegedly cost the state finances Rp578.1 billion in connection with the alleged corruption case of sugar imports at the Ministry of Trade (Kemendag) in 2015 '2016.

The four high-ranking officials of the private sugar company were charged with harming state finances by committing a criminal act of corruption, which enriched eight defendants, including through their respective corporations.

It was stated that the actions of the defendants were carried out together with the defendant Tom Lembong, the defendant Charles Sitorus, and the Minister of Trade for the 2016'2019 period Enggartiasto Lukita.

Thus, the defendants face criminal charges in Article 2 paragraph (1) or Article 3 jo. Article 18 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended and supplemented by Law Number 20 of 2001 jo. Article 55 paragraph (1) 1st of the Criminal Code.
