DPR Plenary Agrees With Inocentius Samsul To Be A Constitutional Court Judge To Replace Arief Hidayat

JAKARTA - The DPR RI Plenary Meeting approved the Candidate for Justice of the Constitutional Court (MK), Inosentius Samsul after undergoing a fit and proper test at Commission III of the DPR RI on Wednesday, August 20, yesterday. Inosentius is the sole candidate proposed by the DPR to replace Arief Hidayat who will retire in February.

In his report, Chairman of Commission III of the DPR Habiburokhman, his party has carried out the process of selecting and determining candidates for Constitutional Justices at the Constitutional Court proposed by the People's Representative Council of the Republic of Indonesia.

"According to the results of the Consultation Meeting in Lieu of the Deliberative Body Meeting, on August 19, 2025, one of whose agendas was to discuss an entry letter from the leadership of the Constitutional Court of the Republic of Indonesia, on August 3, regarding the notification of the end of the term of office of Constitutional Justice Arief Hidayat, the Deliberative Body Meeting gave an assignment to Commission III of the DPR RI to discuss the change of Constitutional Justices," Habiburokhman said at the beginning of his report at a plenary meeting at the Parliament Complex, Senayan, Jakarta, Thursday, August 21.

"Based on the views and opinions of all factions that were unanimously conveyed at the Commission III Meeting of the DPR RI, Commission III of the DPR RI decided to approve Inosentius Samsul's brother as Constitutional Justice, which was proposed by the House of Representatives of the Republic of Indonesia to replace Constitutional Justice Arief Hidayat," he continued.

Habiburokhman stated that the mechanism for submitting Constitutional Justices was carried out by means of objective, accountable, transparent, and open active screening agreed at the Commission III Internal Meeting on August 19, 2025. This is in accordance with the provisions of Article 20 Paragraph 1 and Paragraph 2 of the Constitutional Court which reads, Paragraph 1, provisions regarding the procedures for selection, selection, submission of Constitutional Justices are regulated by each authorized institution as referred to in Article 18 Paragraph 1.

"Therefore, we hope that the elected Constitutional Justice can be determined in this Plenary Meeting and the President will determine it in the near future," said Habiburokhman.

After listening to the report of the Chairman of Commission III of the DPR, Deputy Chairman of the DPR RI Cucun Ahmad Syamsurijal as the chairman of the trial asked Inosentius for approval as a judge of the Constitutional Court to the members of the council.

"We asked the honorable council session. Can the DPR RI Commission III report on the results of the discussion on the change of constitutional judges to the Constitutional Court on whether the DPR's proposal can be approved?", Cucun asked, answered the approval of all the members of the council present.
