KPK Detains 2 Former Pertamina Officials Karen Agustiawan's Subordinate Suspect In LNG Procurement Corruption

JAKARTA - The Corruption Eradication Commission (KPK) officially detained Senior Vice President (SPV) Gas and Power Pertamina 2013-2014, Yenni Andayani and Hari Karyulianto as Director of Gas Pertamina 2012-2014 today.

They are suspects in alleged corruption in the procurement of liquid natural gas (LNG) at PT Pertamina (Persero).

Both of them became suspects after the KPK developed a case that initially ensnared the former President Director of PT Pertamina (Persero), Karen Agustiawan.

"The suspects HK and YA were detained today for the first 20 days," said Acting Deputy for Enforcement and Execution of the KPK Asep Guntur Rahayu at a press conference at the KPK's Merah Putih building, Kuningan Persada, South Jakarta, Thursday, July 31.

Yenni and Hari, continued Asep, were detained in different detention centers.

"The suspect HK was carried out by the KPK Detention Center Branch of the Anti-Corruption Education Center or C1 building while the suspect YA was at the KPK branch detention center at the Red and White Building," said the KPK Director of Investigation.

In this case, Yenni and Hari have made the state lose up to 113,839,186.60 US dollars. They are suspected of giving LNG purchase approval without any procurement guidelines, granting principle permits without being supported by the basis of justification, and technical and economic analysis.

"The purchase of LNG is also without a back to back contract in Indonesia or with other parties so that the imported LNG does not have the certainty of buyers and users," explained Asep.

In addition, LNG imported has never entered Indonesia until now. And the price is more expensive than gas products in Indonesia," said Asep.

Asep also explained that state losses arose because the procurement of LNG was not equipped with a recommendation or permit from the Ministry of Energy and Mineral Resources. The process is also without a GMS or commissioner.

In addition, investigators also found that there were allegations of falsification of the Board of Directors' Approval documents; then there was no report of the Board of Directors' Approval Document to the Commissioner, which is the duty of the Board of Directors in accordance with the AD/ART of PT Pertamina (Persero); intentionally did not report to the Commissioner either the official travel plan or official travel that had been completed from the USA for the signing of the LNG SPA Train 2 Corpus Christi.

As a result of his actions, the two Karen's men were then suspected of violating Article 2 paragraph (1) or Article 3 of the Law of the Republic of Indonesia Number 31 of 1999 concerning Eradication of Criminal Acts of Corruption as amended by Law of the Republic of Indonesia Number 20 of 2001 concerning Amendments to Law Number 31 of 1999 concerning Eradication of Criminal Acts of Corruption in conjunction with Article 55 paragraph (1) to 1 of the Criminal Code.
