Prosecutor's Office Leaves Former Officials Regarding Alleged Corruption Cases To The Prosecutor's Office

PALANGKARAYA - The Central Kalimantan High Prosecutor's Office (Kalteng) handed over the former Head of the North Barito Regency Mining and Energy Service (Kadistamben), namely A, to the District Attorney for North Barito Regency (Justit) related to the alleged corruption case of mining business permits.

"In addition to the former head of the service, we have also transferred DD to the former Head of General Mining of the Mining and Energy Service and I President Director of PT Pagun Taka to the District Attorney of Barut Regency," said Head of the Legal Information Section of the Central Kalimantan High Prosecutor's Office, Dodik Mahendra in Palangka Raya, Thursday.

He revealed that the three suspects were caught in a case of alleged corruption in the issuance of the Regent of Barut's decree regarding the granting of mining business permits from 2009-2012.

He explained that this case began after the enactment of RI Law Number 4 of 2009 concerning Mineral and Coal Mining which was promulgated on January 12, 2009, the issuance of a Mining Business Permit (IUP) must go through the auction process of the Mining Business Permit Area (WIUP).

However, to obtain a Mining Business License (IUP) by avoiding the mining business license (WIUP) auction process, PT. Pagun Taka submitted a request for mining area backup.

"Then by the Regent of Barut at that time (Ir. AY) the application was positioned to the Department of Energy and Mineral Resources of Barut Regency, so a draft of the Regent's Decree on the Approval Letter of Mining Area Reserves which was parameters by the Head of the Barut Regency ESDM Office, namely A and the Head of General Mining of the ESDM Service, namely DD," he said.

Dodik also revealed that the Regent's Decree on the Approval of the Revenue of the Mining Area of PT. Pagun Taka was finally signed by the Regent of Barut, which at that time was held by AY.

The decree has also been given a number with a date of resignation on the date before Law No. 4 of 2009 is valid, so that a Mining Business License of PT. Pagun Taka was issued without going through the WIUP auction process, resulting in the state losing PNBP which should have been obtained from the WIUP auction process.

"The state loss as a result of the actions of the suspects amounted to Rp5,842,855,000 based on the calculation from the Central Kalimantan Province BPKP Representative," he said.

Dodik revealed that the three suspects were charged with Article 2 paragraph (1) jo. Article 3 jo. Article 18 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law Number 20 of 2001 concerning amendments to Law Number 31 of 1999 concerning Eradication of Criminal Acts of Corruption in conjunction with Article 55 paragraph 1 of the Criminal Code.

This disclosure is the commitment of the Central Kalimantan High Prosecutor's Office in eradicating corrupt practices that harm the state and society.

"With this delegation, investigators have completed the investigation process and then submitted it to the Barut District Attorney for the next stage," said Dodik.
