Agus Bentung Demanded 12 Years In Prison For Obscenity Cases

The public prosecutor asked the panel of judges to sentence the defendant I Wayan Agus Suartana (IWAS) alias Agus Bentung to 12 years in a sexual harassment case.

Ricky Febriandi representing a team of public prosecutors from the NTB Prosecutor's Office and the Mataram Prosecutor's Office said the sentence of 12 years in prison was in accordance with the most severe threat in the indictment applied by the prosecutor in the indictment.

The defendant Agus Bentung is a person with a blind person.

"Yes, the demands of 12 years in prison are the maximum threat according to the indictment we apply in the indictment, Article 6 letter C of the Republic of Indonesia Law Number 12 of 2022 concerning the Crime of Sexual Violence," said Public Prosecutor Ricky as quoted by ANTARA, Monday, May 5.

In addition to demanding that the judge impose a sentence of 12 years in prison, the prosecutor also asked the judge to impose a fine of Rp. 100 million, subsidiary to 3 months in prison.

The prosecutor's consideration is a fact of the trial that reveals the number of victims of the defendant's actions is more than one person by doing it repeatedly.

"During the trial, the defendant did not show any attitude of regretting his actions, did not admit it either. That was a burdensome consideration. The only mitigating thing was that the defendant had never been convicted," he said.

He said that in the indictment there was actually a juncto or bond with Article 15 of the TPKS Law relating to the addition of a third of the sentence imposed.

"However, because we know that this defendant has never been convicted, that's why we did not participate in Article 15. If it is applied in the prosecution, the penalty could be 16 years in prison," he said.
