Transportation Truck Corruption, Former Sestama Basarnas Sued 5 Years In Prison

JAKARTA - Main Secretary of the National SAR Agency (Basarnas) for the 2009-2015 period Max Rudand Boseke was charged with imprisonment for 5 years and a fine of Rp. 500 million, subsidiary to imprisonment for nine months related to the alleged corruption case in the procurement of trucks carrying 4WD personnel and rescue vehicles in 2014.

The Public Prosecutor (JPU) of the Corruption Eradication Commission (KPK) Richard Marpaung stated that Max Rudiand had been legally and convincingly proven guilty of committing a criminal act of corruption in the case.

"Thus, the defendant violated Article 2 Paragraph (1) in conjunction with Article 18 of the Corruption Eradication Law jo. Article 55 Paragraph (1) 1 jo. Article 65 Paragraph (1) of the Criminal Code," said the Public Prosecutor at the trial of reading the charges at the Jakarta Corruption Court, Thursday, March 6.

In addition to the main crime, the Public Prosecutor also demanded that the panel of judges impose an additional sentence on MaxRuland in the form of payment of replacement money worth Rp. 2.5 billion, subsidiary to one year in prison.

In dropping the charges, the Public Prosecutor considered several aggravating and mitigating things. The aggravating thing is that MaxRuland's actions did not support the Government's program in eradicating corruption and MaxRuland did not provide honest information.

"Meanwhile, mitigating factors are that the defendant has never been convicted," said the prosecutor.

Apart from MaxRuland, there is also Director of CV Delima Mandiri William Widarta and Head of Sub-Directorate for Prosecution and Supplies of the Directorate of Facilities and Infrastructure of Basarnas Anjar Sulistiyono, who was prosecuted in the same trial.

The two people were demanded to be declared to have committed a criminal act of corruption together, in accordance with the same article as Max Rudand.

Anjar Sulistiyono was charged with imprisonment for 4 years and 6 months and a fine of Rp. 200 million, subsidiary to imprisonment for six months.

Meanwhile, William Widarta was sentenced to 5 years and 8 months in prison, a fine of Rp. 500 million, subsidiary to imprisonment for nine months, and to pay compensation of Rp. 17.94 billion, subsidiary to three years in prison.

In this case, MaxRuland was charged with causing state financial losses of Rp20.44 billion for committing corruption together with the Director of CV Delima Mandiri William Widarta and the Head of the Sub-Directorate for Prosecution and Briefing of the Directorate of Facilities and Infrastructure of Basarnas Anjar Sulistiyono.

The act of corruption allegedly aimed at enriching Max Rudiand by Rp. 2.5 billion and William by Rp. 17.94 billion.
