THR Complaint Post Opened In March, DKI Provincial Government Asks Companies To Fulfill Obligations

"Posko was opened in early March before Ramadan. We set a post to find out which companies do not follow the provisions of the UMP," said Head of the DKI Jakarta Province Manpower, Transmigration and Energy Agency (Disnakertransgi), Hari Nugroho, in Jakarta, Tuesday, February 25.

Towards two weeks before Eid, his party will also go to the field to carry out monitoring. "Usually, 10 days before Eid, THR must be given," said Hari.

However, he has not explained in detail the reporting mechanism that can be carried out by companies or workers to the complaint post.

Hari added that the Ministry of Manpower usually issues a circular regarding the THR about three weeks before the holiday. Before the letter is issued, his party will carry out mitigation to anticipate obstacles in the field.

If there are companies that cannot fulfill the THR payment obligations to employees, then they will conduct an audit of the company's financial condition. "First, we first audit the finances. Usually, if the company is not in accordance with the UMP, they will convey that the financial condition is in deficit. We will mediate, and employees often agree on THR payments in stages or in part," explained Hari.

Namun, jika karyawan tetap menuntut pembayaran THR secara penuh, pihaknya akan kembali mengevaluasi kondisi keuangan perusahaan.

Jika perusahaan masih mampu, maka THR harus dibayarkan secara penuh. Namun, jika kondisi keuangan tidak memungkinkan, maka Disnakertransgi akan melakukan mediasi antara perusahaan dan karyawan.

"If the company cannot fulfill its obligations, of course there will be sanctions. There are also companies that pay THR at the end of the year, around December. But if it is not paid by December, we will give sanctions," said Hari.
