AGO Returns Case Files for Blasphemy Suspect M Kece
JAKARTA - The Deputy Attorney General for General Crimes The Attorney General's Office returned the case file for the alleged blasphemy of suspect Muhammad Kece to the Indonesian National Police-Criminal Investigation Agency (Bareskrim) to be completed by investigators (P-16).
The Attorney General's Office of Penuspenkum Kapuspenkum Leonard Eben Ezer Simanjuntak said the prosecutor's team assessed that the case file for the alleged criminal act of blasphemy on behalf of the suspect Muhammad Kece was incomplete, both formally and materially.
"The research prosecutor team has given instructions or P.18 on Monday (6/9) and P.19 on Wednesday (8/9) to be completed by the Investigation Team of the Indonesian Police Criminal Investigation Agency (Bareskrim Polri)," Leonard said as quoted by Antara, Tuesday, October 19.
In this case file, the suspect Muhammad Kece is suspected of violating Article 45a paragraph (2) jo. Article 28 paragraph (2) of Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions (ITE) and/or Article 156 and/or Article 156 letter a of the Criminal Code.

Head of the Public Information Section (Kabagpenum) of the National Police Public Relations Division, Grand Commissioner Ahmad Ramadhan, when confirmed regarding the return of the case file by the prosecutor to the Criminal Investigation Police investigator, stated that he had not received a notification letter for the return of the case file.
"There is no information regarding the return of the case file," said Ramadhan.
Muhammad Kosman alias Muhammad Kece was arrested by the Directorate of Cyber Crime of the Police together with the Bali Police at his hiding place after a video of insulting religious symbols went viral.
The arrests were made on Tuesday, August 24 in North Kuta District, Badung Regency, Bali. After that, Kece was flown to Jakarta for examination and detention at the Criminal Investigation Unit of the Police on Wednesday, August 25.
Kece was then detained for 20 days starting from August 25 to September 13, 2021. Until now, his detention period has been extended.
However, on the first night occupying an isolation cell room at the Criminal Investigation Unit of the Police, Muhammad Kece was subjected to mistreatment allegedly committed by fellow prisoners. Besides being mistreated, M Kece was also smeared with human waste by the perpetrators.
Muhammad Kece then made a police report with the number LP 0510/VIII/2021/Bareskrim.Polri dated August 26, 2021. In the report, the name of Inspector General Napoleon Bonaparte was one of the reported parties.
The report has been followed up by the Directorate of General Crimes (Dittipidum) of the Criminal Investigation Department of the National Police until now 13 witnesses have been examined, including Muhammad Kece as the reporter and Inspector General of Police Napoleon Bonaparte as the reported person.
In addition, the Div Propam Police also conducted an examination of seven members of the Police who served as guards for prisoners and the Head of the Criminal Investigation Unit of the Police related to allegations of disciplinary violations leading to the mistreatment of M Kece.
