The Cause Of The Jember Regent Faida Being Impeached
JAKARTA - The Regent of Jember Faida was officially impeached politically by the Jember Regency DPRD. The impeachment was carried out in a plenary meeting of the right to express an opinion which was held on July 22, 2020.
As many as 45 members from 7 factions of the Jember DPRD assessed that Faida had violated her oath and promise of office and violated a number of provisions in the legislation. However, Faida did not attend the event.
Chairman of the PDI-P Faction, Edi Cahyo Purnomo, said there were many facts about the failures, violations and all the chaos of the Jember Regency Government since the leadership of Regent Faida. Even the results of the BPK audit on the implementation of the Jember 2019 APBD received a disclaimer.
"The Jember Regency Government under Faida's leadership has failed to carry out the mandate of the people in managing trillions of state money. In addition, the functions and bureaucratic system have stopped because of everything the regent said," said Edi as quoted by Antara, Sunday, July 26.
Likewise, the spokesperson for the National Awakening Faction (FKB) Sri Winarni said Faida had committed several violations of the Law. This of course cannot be tolerated.
"For example, the transfer policy carried out by the Regent of Jember was not in accordance with Law No. 5 of 2015 and the Regent of Jember did not comply with the recommendations of the ASN Commission for violations of the merit system in transferring employees in the Jember Regency Government," he said.
Meanwhile, Chairman of the Jember DPRD, M. Itqon Syauqi, said that the impeachment was a follow-up to the implementation of the interpellation rights and inquiry rights that had been carried out by the council because the recommendations of the legislature on these two rights were ignored by the Regent of Jember Faida.
Political tensions between the regent and the council have occurred since December 2019. The Jember DPRD proposed the right of interpellation to Regent Faida to get answers to problems with KASN, the results of special examinations by the Minister of Home Affairs, and sanctions from the PAN-RB Ministry. However, Faida did not attend the interpellation plenary session.
Then the council's rights continued with the proposed inquiry rights and formed a questionnaire committee which found many irregularities in the policies carried out by the Regent of Jember.
In several notes, the Jember DPRD questionnaire rights committee stated that the Regent Faida changed the Position Regulation, Work Procedure Organization (KSOTK) without heeding the provisions so that Jember did not get a quota for CPNS and Government Employees with a Work Agreement (P3K) in 2019.
There were 30 regent regulations (Perbup) SOTK Jember which were annulled by the East Java Provincial Government and the Ministry of Home Affairs because they were considered to have violated statutory regulations.
Then the Jember Regent's policy of making mutations was deemed to have violated the merit system and personnel regulations so that the State Civil Apparatus Commission (KASN) issued a recommendation that must be implemented by the regent.
Faida has also made ASN mutations by issuing 15 Regent Decrees, but the Minister of Home Affairs believes that all these mutations violate the merit system and laws and regulations. The Minister of Home Affairs and the Governor of East Java also asked the Regent of Jember to revoke 15 decree transfers.
"The Jember DPRD considers the regent to have violated the oath of office and has violated statutory regulations, so we act through the right to express an opinion agreeing to impeach Regent Faida," said Itqon.
The impeachment of the Regent of Jember is also inseparable from Faida's policy in budget management which violates procedures and runs itself without involving the DPRD so that the discussion of the 2020 Regional Budget always ends at a dead end, even the Minister of Home Affairs intervenes to mediate between the Jember DPRD and the Jember Regent.
He said the DPRD administratively cannot dismiss the regent, but what can be done is politically impeachment or dismissal of the regent because the one who can dismiss the regent is the Minister of Home Affairs through a Supreme Court fatwa. Therefore, the Jember DPRD will immediately send the right to express the opinion to the Supreme Court.
Responding to the impeachment, the Regent of Jember Faida stated he respects the right to express the opinion taken by the Jember DPRD because it has been regulated in law and will follow the procedure.
He said a number of issues that were submitted by the Jember DPRD to impeach him had been resolved at the mediation table through clarifications that had been made at the Ministry of Home Affairs (Kemendagri) and previously at the East Java Provincial Government.
According to him, all the problems are clear and the Jember APBD is legally using regional head regulations (perkada), then the KSOTK problem is clear and in early 2020 a decree (SK) has also been made, so that all issues discussed have reached an agreement and signed without coercion.
"It's not that easy to assign a regent because we have a mandate from the people, so we continue to carry out our duties as Regent of Jember," said Faida, who became the incumbent in the 2020 Pilkada through the individual route.
The first female regent in Jember said that bureaucratic activities in the Jember Regency Government were running as usual, not affected by impeachment by the Jember DPRD. He also focuses on handling COVID-19 as the head of the COVID-19 Task Force in Jember.
Faida admitted that she was ready to follow the mechanisms and procedures related to her impeachment process which the council would process to the Supreme Court. He assessed that the impeachment that took place in Jember could be good political and state governance education for the community, as well as good education for government.
He said the right to express an opinion made by the Jember DPRD was flawed in procedure because his party did not receive a copy of the proposed material for the right to express an opinion in accordance with Government Regulation (PP) Number 12 of 2018.
