Facing Crisis, Vice President Ma'ruf Asks Minister Yasonna To Adopt Rukhsah Concept In Islamic Law, What Is It?
JAKARTA - Vice President Ma'ruf Amin asked the Ministry of Law and Human Rights (Kemenkumham) to adopt the concept of rukhsah or the provision of facilities in an emergency. This is intended so that regulations in the country are ready to face various crisis situations.
This was conveyed by the Vice President while giving a key speech at the national seminar 'The Role of the Ministry of Law and Human Rights in Accelerating a Healthy Indonesia and National Economic Recovery,' on Monday, October 11.
"The Ministry of Law and Human Rights may consider adopting the concept of rukhsah or emergency in the relevant legislation so that legislation and regulations are more anticipatory in dealing with a crisis situation in the future," said Vice President Ma'ruf Amin as quoted by Antara, Tuesday, October 12.
As a government agency tasked with and functioning in the process of drafting, analyzing, harmonizing and evaluating legislation in Indonesia, the Ministry of Law and Human Rights must be better prepared to face potential crises in the future.
The COVID-19 pandemic crisis, said the Vice President, could be a lesson to be able to formulate regulations quickly and accurately to support efforts to handle the crisis.
"Based on experience so far, our response in the legal field is often too late in anticipating the demands of a rapidly developing situation, including emergency situations," said the Vice President.
Regarding the theme of national economic recovery in the midst of a pandemic, the Vice President gave an example of the policies set by the government in providing facilities or easing, such as the concept of rukhsah in Islamic law.
The easing, among others, is related to the business competition law enforcement mechanism by the Business Competition Supervisory Commission (KKPU), arrangements for the procurement of goods and services without tenders for products related to the handling of the pandemic, as well as regulations from the Financial Services Authority (OJK) to ease the installment obligations of bank creditors.
"Partially, the application of the rukhsah concept during the COVID-19 pandemic already has a precedent," said the Vice President.
Meanwhile, Minister of Law and Human Rights Yasonna Laoly said it was necessary to conduct studies and collaborations to determine regulations related to handling the pandemic and recovering the national economy.
"It is hoped that the strategic role of the Ministry of Law and Human Rights in restructuring and reforming law and human rights can respond to the situation and challenges that arise due to the COVID-19 pandemic," said Yasonna.
