The Reason The KPK Insists It Will Not Carry Out The Ombudsman's Corrective Action
JAKARTA - The Corruption Eradication Commission (KPK) insists on not following up on corrective actions issued by the Indonesian Ombudsman due to the discovery of maladministration and abuse of authority in the National Insight Test Assessment (TWK) of its employees.
Acting KPK Spokesperson for Enforcement, Ali Fikri, said that this stance was taken in accordance with a legal mechanism in the rules of the Indonesian Ombudsman. Moreover, his party from the beginning has expressed its objection to the final report on the results of the examination which was submitted some time ago.
"KPK has finished responding to the LAHP by expressing objections. This objection is part of a legal mechanism that is regulated and applies to the examination process by ORI itself," Ali told reporters, Monday, August 16.
Furthermore, Ali said that this objection had also been conveyed to the Ombudsman by letter. "The letter has been received by ORI," he emphasized.
There are four corrective actions that should be carried out by the KPK, namely asking the KPK leadership to continue to transfer the status of Novel Baswedan and 74 other employees who were declared not to have passed the TWK to become State Civil Apparatus (ASN). Next, the Ombudsman asked the KPK not to use TWK as the basis for the dismissal of 75 employees.
Then, the anti-corruption commission was asked to carry out official education regarding national insight for employees who were terminated because they did not pass the TWK. Finally, the KPK was asked to explain to its employees about the consequences of implementing TWK in the form of information or legal documents.
However, the KPK from the start refused because it considered the Ombudsman to be unfair in providing its recommendations. In addition, the anti-corruption commission also assessed that the Ombudsman did not respect their authority in carrying out TWK as a condition for transferring their employee status to State Civil Apparatus (ASN).
