Receive A Copy From The Ombudsman Regarding TWK Maladministration, KPK Learns The Details

JAKARTA - The Corruption Eradication Commission (KPK) will study the findings of maladministration in the National Insight Test Assessment (TWK) process as a condition for the transfer of employee status. Moreover, currently the anti-corruption commission has received a copy of the document from the Ombudsman of the Republic of Indonesia.

"We have received a copy of the said document and will immediately study it in more detail, the document containing suggestions and input from the Ombudsman," Acting KPK Spokesperson for Enforcement Affairs Ali Fikri told reporters, Wednesday, July 21.

Ali emphasized that the KPK certainly respects the results of the examination conducted by the Indonesian Ombudsman.

In addition, the KPK is also waiting for the Supreme Court's decision regarding the results of the judicial review of Perkom Number 1 of 2021 as well as the Court's decision on the lawsuit filed by several parties.

Ali also ensured that his party had not terminated dozens of employees who had not passed the TWK. "KPK has never dismissed 75 employees who were declared ineligible (TMS) to become ASN," he said.

He said that the KPK is currently still focused on holding State Defense and National Insight Education. The activity, he said, was currently underway and was attended by 18 employees who had previously been declared unsuccessful.

Even so, Ali emphasized that the anti-corruption commission would obey every legal decision. Including, the findings of the Ombudsman in the TWK.

"As a law-abiding state institution, the KPK will respect every legal decision and the KPK will notify the public," he said.

As previously reported, the Ombudsman of the Republic of Indonesia found that there was maladministration in the transfer of the status of KPK employees to ASN. This was conveyed by the Chairman of the Indonesian Ombudsman Mokhammad Najih in an online press conference on Wednesday, July 21 today.

"We found the potential for mala-administration and in general, from the results of our examination, we did find them," said Najih.

One of the findings is irregularities regarding procedures and abuse of authority in transferring the status of KPK employees to ASN. First, related to the work contract and memorandum of understanding between the KPK and the State Civil Service Agency (BKN).

The Ombudsman obtained the findings of a memorandum of understanding for the procurement of goods and services for the KPK-BKN signed on April 8, 2021 and the contract on April 26, 2021. "However, it was made with a date pushed back to January 27, 2021," said Ombudsman Member Robert Na Endi Jaweng.

In addition, the deviation was also concluded because the TWK of KPK employees took place on March 9, 2021 or before the memorandum of understanding and contract was signed.

"You can imagine that the goods were signed in April, the date was back to January, the activities were carried out in March. This is a procedural deviation which for us is quite serious in the administration of an institution and may also be related to legal issues," said Robert.
