Regarding the Execution of the Sultan Hotel Land, This is the Word of Indobuildco Legal Representative Hamdan Zoelva

JAKARTA - Regarding the execution of the Sultan Hotel land, PT Indobuildco's Legal Counsel, Hamdan Zoelva, said that all possibilities could still happen before June 18, 2026. Thus, according to him, the plan for the execution of the eviction is not final.

The Central Jakarta District Court has set the implementation of the execution of the emptying of Block 15 GBK of the former Sultan Hotel Area to be carried out on June 18, 2026.

Hamdan said his party strongly rejected the execution plan which could potentially be a source of legal problems and injustice. According to him, if the execution is still imposed, it will cause various problems.

Hamdan assessed that the statement that the execution was the final stage was too simplistic. Because, on the land there are hotel buildings, business activities, workers, tenants, vendors, and the rights of third parties that cannot be ignored.

"What must be understood is that the land is not the building and not the hotel business. The Sultan Hotel business is absolutely owned by PT Indobuildco," said Hamdan in his statement, Wednesday, May 27.

Hamdan explained that the Sultan Hotel building was built by PT Indobuildco, not from state funds, and not in the Build, Operate, Transfer or BOT scheme. Therefore, the building and hotel business cannot automatically be taken over just through the execution of eviction.

"The Sultan Hotel building is not a BOT. The building was built by PT Indobuildco itself. So there is no basis for taking over the building and business without legal mechanisms and fair compensation," he said.

Hamdan also emphasized that if the execution was carried out by ignoring the rights of buildings and businesses, what happened was not just the emptying of land, but the cessation of business activities at the Sultan Hotel.

According to Hamdan, this will have a wide impact on workers, tenants, business partners, events and state revenues from hotel economic activities.

"Hotel Sultan is a service business. If the execution is carried out incorrectly, the hotel will stop operating. This is not only detrimental to Indobuildco, but also workers, tenants, business partners, and the country because taxes from hotel activities are also affected," he said.

Hamdan also rejected the assumption that there was no longer a legal reason to postpone the execution. According to him, there are still important conditions that must be met before the execution of the verdict is immediately carried out.

Including, clarity of the object, protection of the rights of third parties, and guarantees as stipulated in the Supreme Court regulations. Especially if there is peace.

"PPKGBK can call this the final, but the execution must still be legal according to law. The court's decision does not mean that all legal requirements are automatically met. There must be clarity of the object, protection of the rights of third parties, and guarantees as required by SEMA," he said.

Hamdan said PT Indobuildco did not reject the settlement of the dispute. Instead, Indobuildco still opened a space for dialogue and negotiation with the government to find a fair, measurable, and legal solution.

"Indobuildco is not against the state. Indobuildco asks that the law be enforced properly. If the government wants to solve this problem, sit down together, calculate each other's rights, including the value of buildings, businesses, and land rights. If there is peace, then the execution is guaranteed to stop," he said.
