Convinced To Win, MAKI Hopes KPK To Attend Pretrial Session Of BLBI SKL Case
JAKARTA - The Corruption Eradication Commission (KPK) has been asked to attend the pretrial hearing for the termination of the investigation into the alleged corruption case in the issuance of the BLBI SKL (Certificate of Settlement of Bank Indonesia Liquidity Assistance) with the suspect Sjamsul Nursalim and his wife Itjih Nursalim.
This was conveyed by the Coordinator of the Indonesian Anti-Corruption Society (MAKI), Boyamin Saiman. Originally, this inaugural trial would be held at the South Jakarta District Court.
Boyamin said that the KPK as a law enforcement agency should respect the legal process by attending this pretrial hearing and explaining the reasons for issuing the Order to Terminate Investigation (SP3) in the BLBI case.
"Hopefully the KPK will be present as a form of respect for the legal process and of course the KPK will provide reasons, answers, and evidence for the issuance of the SP3", said Boyamin in an official statement received by VOI, Monday, June 7.
Boyamin said he was confident that he would win this lawsuit. This is because the KPK stopped the BLBI (Bank Indonesia Liquidity Assistance) Sjamsul and Itjih cases based on the decision of the Supreme Court of Cassation, which released the former Head of the National Bank Restructuring Agency (BPPN), Syafruddin Arsyad Temenggung of all criminal charges.
In fact, Boyamin emphasized that Indonesia's law does not recognize one person's decision as to the basis for stopping other people's cases.
"MAKI is confident that it will win this lawsuit because Indonesian law does not adhere to one person's decision as to the basis for stopping other people's cases or jurisprudence. A suspect can be convicted or acquitted after going through the trial process, not based on SP3 by KPK investigators", he said.
"This SP3 has been issued by the KPK on April 1, 2021, on the grounds of the release of Syafruddin Arsyad Temenggung in the BLBI case. For the SP3, MAKI has registered a lawsuit on April 30, 2021, and will have its first trial today", said Boyamin.

Previously, the KPK appreciated the pretrial effort submitted by MAKI regarding SP3 in the alleged corruption case of SKL BLBI which ensnared Sjamsul and Itjih.
The KPK hopes that this pretrial effort will result in a legal breakthrough in handling the alleged corruption case. This is because the Corruption Eradication Commission believes that Sjamsul and Itjih and Syafruddin Arsyad Temenggung have committed the acts as charged by the Prosecutor.
"KPK appreciates the pretrial efforts put forward by the community and hopes that there will be a new legal breakthrough because, from the very beginning, the KPK believes that the BLBI-BDNI (National Trade Bank of Indonesia Bank Indonesia Liquidity Assistance) case has sufficient evidence and the fact is that the KPK Prosecutor's indictment is proven according to law at District Court and appeals at Jakarta High Court", said KPK spokesman Ali Fikri in his statement, Monday, May 3.
Ali ensured that his party would follow the pretrial process and remain committed to carrying out their duties and authorities to eradicate corruption as much as possible by applicable laws.
"Although it has been regulated in the law, the KPK is not easy to decide on the termination of the investigation and we hope that the polemic regarding this matter will be stopped. Currently, the KPK is focusing on continuing to settle cases at the investigation stage of other cases, including of course several cases that have been proven at trial and are currently being carried out development investigations as well as cases where the suspects are still on the DPO (wanted list) status", said Ali.
