15 DPRD Members Dispute Protection To LPSK, NTB Prosecutor's Office: Go Ahead

Head of the West Nusa Tenggara (NTB) High Prosecutor's Office, Wahyudi, invited legislators who received bribes in the 2025 NTB Provincial DPRD gratification case to apply for protection to the Witness and Victim Protection Agency (LPSK).

"That's the basic right of humans. Go ahead, I can't stop it," Wahyudi said at a press conference commemorating World Anti-Corruption Day (Hakordia) at the NTB Prosecutor's Office building, Mataram, Antara, Tuesday, December 9.

Regarding whether the request for protection can affect the investigation process that has named three suspects, Wahyudi emphasized that his party is still waiting for the results of the LPSK review as an institution that has full authority.

"That's LPSK's domain. From our side, as long as it helps law enforcement officials to prove it, we accommodate it. If it doesn't help, we will consider it," he said.

Wahyudi also did not rule out the possibility of implementing Article 5 paragraph (2) of Law Number 20 of 2001 concerning the Eradication of Corruption Crimes to state officials who are recipients of bribes.

However, he emphasized that the application of the article must fulfill the legal evidence in accordance with Article 184 of the Criminal Procedure Code. Tracing related to mens rea or malicious intentions from bribe recipients is also part of the development of the investigation.

"We'll see later, it's still under analysis from the investigators' friends to what extent they are in the area," he said.

In this case, the prosecutor's office has named three legislators as suspects, namely Indra Jaya Usman (IJU), Hamdan Kasim (HK), and Muhammad Nashib Ikroman (MNI). The three were previously declared to have acted as bribes. The gratuity money received by dozens of legislators is said to have come from the three suspects.

At least Rp2 billion of gratuity money has been entrusted by dozens of legislators to the prosecutor's investigators as part of the evidence. This also strengthens the application of Article 5 paragraph (1) letter b of the Anti-Corruption Law to the suspects as gratuities givers.

LPSK expert, Tomi Permana, said that his party had received at least 15 requests for protection from members of the NTB DPRD regarding this case.

The application is included in the category of Fulfillment of Procedural Rights (PHP) because the applicants are still witnesses.

"There are several conditions that must be met in accordance with Article 28 paragraph (1) of Law Number 13 of 2006, starting from the level of threats, track records, to psychological assessments," said Tomi.

According to him, because this case is related to corruption, LPSK must also see the extent of the threats that may arise against the applicants in the process of uncovering the case.

"This is still being investigated," he said.
