The Decision To Empty The Sultan Hotel Is Considered To Ignore Legal Certainty

JAKARTA - The attorney for PT Indobuildco, Hamdan Zoelva, assessed the decision of the Central Jakarta District Court which ordered the clearing of land for former HGB No. 26 and No. 27/Gelora, the Sultan Hotel area, as a step that does not meet the principle of legal certainty. Decision Number 208/Pdt.G/2025/PN.Jkt.Pst was read out through e-court on November 28, 2025 without the presence of the parties.

Hamdan emphasized that the emptying order should only be imposed if the court has clearly determined the status of land ownership. In this case, he said, the panel of judges never decided who the legal owner of the land was, but immediately ordered the emptying.

"Without the clarity of land rights, the implementation of decisions like this is against the objective and constitutional principles of law enforcement," said Hamdan, Thursday, December 4.

He explained that PT Indobuildco has a strong legal basis, namely the Decree of the Minister of Home Affairs No. 181/HGB/DA/72 dated August 3, 1972, which became the basis for the issuance of Certipikat HGB No. 20/Gelora and its fractions HGB No. 26 and No. 27 on behalf of PT Indobuildco. The extension of HGB in 2002 also confirmed that the land was established on state land, not HPL status.

Hamdan also criticized the fact that for more than five decades PT Indobuildco built and managed the area with its own funds, fulfilled tax obligations, and contributed to the economy through thousands of workers and business partners. However, he said, the company was treated as if it had no legitimate rights.

PT Indobuildco has never given up its rights and has never received compensation from any party. So the emptying without a firm ownership basis raises a bad precedent for law enforcement," he said.

Hamdan warned that acts of emptying without certainty of rights could undermine investor confidence in the Indonesian legal system and create uncertainty for business actors.

He emphasized that PT Indobuildco will take all available legal measures to defend the company's rights and assets and ensure that the principle of justice is upheld.
