Support The Constitutional Court's Decision, PKB Legislator: Active Police Occupying Civil Positions Must Retire Now

The decision of the Constitutional Court (MK) which prohibits members of the Indonesian National Police (Polri) from holding civilian positions has the support of Member of Commission III of the DPR RI from the PKB faction, Abdullah, who emphasized that all members of the National Police must comply with the final and binding decision.

According to Abdullah, there is no reason for the police institution to postpone the implementation of this decision. The choice for the police who are currently in civil office is now only two: resign from the Police or return to duty in their original institution.

"If they want to remain in civil office, then they must retire from the National Police," Abdullah said to reporters in Jakarta, Friday, November 14, 2025.

The Constitutional Court Gives Legal Clarity For Netrality

The decision is contained in case Number 114/PUU-XXIII/2025. The Constitutional Court stated that the phrase or not based on the assignment of the National Police Chief' in Explanation of Article 28 paragraph (3) of Law Number 2 of 2002 concerning Police is unconstitutional and has no binding legal force.

This means that members of the National Police can only hold positions outside the institution if they have resigned or retired. Abdullah assessed that this step by the Constitutional Court is very important to provide legal clarity and maintain institutional principles.

The police must comply with and implement the final and binding Constitutional Court's decision. Since this decision is issued, active police officers who occupy civilian positions must be prepared (resigning from the Police)," said the PKB legislator from the Central Java electoral district.

On the other hand, if the active police do not want to retire from the police, then they must immediately leave their occupied civilian positions and return to carrying out their duties at the Police institution.

Abdullah emphasized that the Constitutional Court's decision is crucial to maintain the principles of neutrality, professionalism, and limits of authority between state institutions. He assessed that the placement of active Polri members in civilian positions has often generated overlapping authority that has the potential to interfere with the principles of a healthy check and balances.

"With this decision, I hope that there will be no more regulatory ambiguities so that all parties can carry out their respective institutional functions more clearly and responsibly," he concluded.
