Family Of Kacab Bank Victims Demands Article Of Premeditated Murder: Not Accepting Called Ordinary Kidnapping
JAKARTA - Mohammad Ilham Pradipta's family (MIP), the Head of the Sub-Branch (KCP) of a bank in Central Jakarta who was the victim of kidnapping and death, came to the Polda Metro Jaya to ask that the perpetrators be charged with Article 340 of the Criminal Code regarding premeditated murder.
"We represent the victim's family demanding that the perpetrators be subject to the article of murder, the highest being Article 340 of the Criminal Code. We are here to meet the investigator's leadership and convey the aspirations," said Boyamin Saiman, MIP's family attorney, in Jakarta, Tuesday, October 21.
Boyamin said that his party received information that the case file had been transferred to the public prosecutor, and hoped that there would be instructions from the prosecutor's office so that the articles applied were heavier.
"Hopefully the prosecutor's instructions also point to Article 340 or at least 338 of the Criminal Code (ordinary murder), because we cannot accept this incident, it is only considered an ordinary kidnapping," he said.
He said there were two important notes that strengthened the alleged element of planning. First, three days before the kidnapping incident, the victim was visited by three people with the initials D, R, and W who were suspected of being part of the group of perpetrators.
They had persuaded the victim, but failed. It seems that the failure was reported to the main suspect, DH. After that, the victim was allegedly threatened and eventually eliminated," said Boyamin.
The second note, he continued, was that the initials D were said to have come from Bandung and had been convicted of embezzlement before joining the DH group.
He assessed that D, R, and W must also be charged with attempted bank burglary, because they are suspected of being involved in the initial scheme of the crime.
This series of events shows that the bank burglary attempt has been planned. If they can escape the murder article, they must still be processed because it is part of an attempted burglary," he said.
Previously, the Directorate of General Criminal Investigation of the Metro Jaya Police had named 15 suspects in the kidnapping case that led to the death of MIP.
The suspects were charged with Article 328 of the Criminal Code concerning kidnapping and Article 333 of the Criminal Code concerning deprivation of freedom resulting in death, with a maximum threat of 12 years in prison.
