Bandung Zoo Corruption Defendant Sentenced To 7 Years In Prison
Bandung Corruption Court (Tipikor) sentenced the defendants in the Bandung Zoo (Bandung Zoo) corruption case Raden Bisma Bratakoesoema and Sri Devi to 7 years in prison each.
The trial was chaired by the chairman of the panel of judges Rachmawaty, as well as judges members of Panji Surono and Ahmad Gawi, at the Corruption Court at the Bandung District Court, last Tuesday.
The two defendants were declared legally and convincingly proven to have violated the law according to the primary indictment, namely Article 2 paragraph 1 Jo Article 18 of Law Number 20 of 2001 concerning the Eradication of Criminal Acts of Corruption in conjunction with Article 55 paragraph (1) 1st of the Criminal Code.
"The trial, stated that the two defendants Bisma Bratakoesoema and Sri Devi had been legally and convincingly proven guilty of committing a criminal act of corruption together. Sentencing the two defendants to seven years in prison," said Rachmawaty in reading his verdict quoted from Antara.
In addition, the two defendants were subject to a fine of Rp. 400 million, a subsidiary of two months. Then, for Sri, it was decided to pay compensation of Rp. 14.9 billion, while Bisma was Rp. 10.1 billion.
If the defendant is unable to pay the replacement money within one month, after this decision, the defendant's property will be confiscated by the prosecutor to fulfill the replacement money.
"And if the money is not sufficient, the replacement fee will be replaced by two years of detention," said Rachmawaty, who invited the two defendants to think a week related to this decision.
During the trial of the verdict, the court was seen adding to the strength of security by alerting several TNI members at the door of the courtroom.
In the description of the West Java Prosecutor's Office indictment at the previous trial, it was initially stated that the Bandung Zoo land was managed through a rental mechanism with the Bandung City Government.
At that time, the Tamansari Wildlife Foundation was still routinely paying rent to the City Government since 1970.
Then, on November 30, 2007, it was stated that the conditional land use permit had expired. However, then, the Tamansari Wildlife Foundation, which was still commanded by R. Romly S. Bratakusumah at that time, did not pay any more of its lease obligations, even though it still utilizes land in Bandung Zoo.
Because they still control Bandung Zoo land without a rental mechanism, the Bandung City Government also suffered losses due to this condition. The value is based on the report on the results of the audit of regional financial losses recorded at around Rp59 billion.
As a result, the actions committed by Bisma and Sri have caused state financial losses of Rp. 25.5 billion. The details are Rp. 6 billion which should have been used to pay land lease agreements, Rp. 16 billion for land leases, and Rp. 3.4 billion for land and building tax payments (PBB).
Bisma and Sri were charged with violating Article 2 paragraph (1) in conjunction with Article 18 of Law Number 20 of 2001 concerning the Eradication of Corruption in conjunction with Article 55 paragraph (1) of the 1st Criminal Code, as the primary indictment.
