Kementerian ATR/BPN Kaji Komersialisasi Tanah Waqf Menjadi Mal, Hotel Hingga Factory

PEKALONGAN - The Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) is working on a new breakthrough, which is to allow commercialization or productive waqf on waqf land.

This is to answer the challenge of waqf land in Indonesia, which is not only a matter of stagnant certification, but also about unproductive or stalled assets.

Minister of ATR/Head of BPN Nusron Wahid revealed that his party had held an intensive meeting with the National Sharia Council (DSN) and the Indonesian Waqf Agency (BWI) to ask for a fatwa.

The essence of the study is to find legal loopholes so that waqf land can be issued property rights above it, making it equivalent to management rights (HPL) in industrial areas.

"We will review whether the waqf land is not lost, but for the sake of being productive, HPL is published on waqf land," said Nusron in his remarks at the KKN Delivery Ceremony of the 63 Thematics of Ecoteology and Land in Pekalongan, Central Java, Monday, October 13.

"We are asking for a fatwa from the National Sharia Council, the point is that it is permissible not to certify the land on waqf land," he continued.

The DSN-BWI study leads to a provisional conclusion that determines the legality of commercialization, namely the intention of wakif (the waqf) when announcing the waqf.

In other words, if the waqf pledge states that the land is used "any for the benefit and benefit of the people", later on the land can be issued the Right to Use Business (HGU) or Building Use Rights (HGB) within a certain period of time.

In this scheme, the waqf status is not lost. Waqf land remains an asset of the people and does not switch ownership. Then, HGU / HGB can be issued on waqf land.

The income from the HGU/HGB rental will be productive income that has a multiplier economic effect for the benefit of the people, saving waqf land from "swelling" or "swelling" status.

Menurut Nusron, di atas tanah wakaf tersebut boleh dibangun rumah sakit, mal, tempat pertemuan, hotel, bank, termasuk kawasan industri untuk pabrik dalam jangka waktu tertentu, sehingga pendapatannya tersebut bisa produktif.

"Tujuannya adalah memaksimalkan potensi ekonomi dari aset-aset umat yang terletak di lokasi strategis," pungkasnya.

According to Nusron, on the waqf land, hospitals, malls, meeting places, hotels, banks, including industrial areas for factories within a certain period of time, so that their income can be productive.

"The goal is to maximize the economic potential of the people's assets located in strategic locations," he concluded.
