Case Of Rape Of Children-Spreading Immoral Content, Former Ngada Police Chief Sueded 20 Years In Prison

JAKARTA - Former Ngada Police Chief AKBP Fajar Widyadharmana Lukman Sumatmadja was sentenced to 20 years in prison by the Public Prosecutor's Team (JPU) in a follow-up trial with the agenda of reading the demands at the Kupang District Court (PN), Monday, September 22.

The prosecutor's team consists of Arwin Adinata, Kadek Widiantari, Samsu Jusnan Efendi Banu, and Sunoto, charged the defendant with a combination (cumulative alternative).

In addition to imprisonment, the Public Prosecutor demanded that the defendant pay a fine of Rp. 5 billion, subsidiary to 1 year and 4 months in prison, and pay restitution of Rp. 359.16 million for three child victims according to the recommendations of the Witness and Victim Protection Agency (LPSK).

Evidence in the form of clothes, cell phones, laptops, and video recordings was requested to be confiscated for destruction, while the victim's belongings were returned.

The prosecutor considered that there was nothing to relieve the defendant. On the other hand, the defendant's actions were considered burdensome because they caused deep trauma, tarnished the name of the police institution, caused public unrest, and did not support the government's efforts to protect children.

"The state must not lose against sexual crimes against children. This demand is proof of the prosecutor's commitment to protect the future of the nation's generation," said Samsu Jusnan Efendi Banu when reading the indictment.

Raka added that there were several things that aggravated the defendant's sentence, namely that the defendant did not admit his actions and did not show any remorse, then the defendant's actions also caused deep trauma to the victim's child.

This case also, he said, went viral on social media, causing widespread public unrest. As law enforcement officers, the defendant should be an example, but instead tarnish the good name of the institution.

On the other hand, the defendant's actions damaged the image of the National Police and the nation in the eyes of the international community and did not support the government's program in child protection.

The trial will resume on Monday, September 29, with the agenda of reading a memorandum of defense (pledoi) from the defendant's legal adviser.
