DPR Legislator Asks TNI Headquarters To Explain Ferry Irwandi's Actions Assessed As Cyber Defense Threatens

JAKARTA - Member of Commission I DPR RI TB Hasanuddin, asked TNI Headquarters to explain openly what action was taken by influencer Ferry Irwandi until he was deemed to have violated the law or threatened cyber defense.

This was said by TB Hasanuddin following the TNI's consultation with the Police because they found indications of defamation by Ferry Irwandi.

"It needs to be explained clearly by the TNI Headquarters or Dansatsiber, what action was taken by Ferry Irwandi so that it is considered to threaten cyber defense within the Ministry of Defense and the TNI," said TB Hasanuddin to reporters, Wednesday, September 10.

TB Hasanuddin emphasized that based on the decision of the Constitutional Court, defamation of the institution cannot be processed criminally.

"The Constitutional Court's decision has firmly stated that defamation can only be processed criminal law if it is addressed to individuals, not institutions," said the retired TNI officer.

TB Hasanuddin also mentioned the cyber defense aspect. Based on the Ministry of Defense's 2014 Cyber Defense Guidelines, cyber defense functions are limited to the Ministry of Defense and the TNI.

Therefore, the member of the defense commission asked the TNI to straighten out Ferry Irwandi's actions so that they were considered to have violated the law or threatened cyber defense. According to him, so that the public can get a clear understanding.

The PDIP legislator also emphasizes transparency and legal certainty in every law enforcement process.

"There should be no steps that cause multiple interpretations or obscure the limits of authority between freedom of expression, individual rights, and institutional authority," he concluded.

As is known, the Commander of the Cyber Unit at the TNI Headquarters, Brigadier General Juinta Omboh Sembiring, said that his party found the alleged crime by Ferry Irwandi. The findings, according to Juinta, came from the results of cyber patrols which were then consulted to the Polda Metro Jaya on Monday, September 8.

The four TNi personnel commanders were present at the consultation agenda, namely Danstsiber TNI Brigadier General Juinta Omboh Sembiring, Danpuspom Major General TNI Yusri Nuryanto, Kapuspen TNI Brigadier General (Mar) Freddy Ardianzah, and Kababinkum TNI Admiral Farid Ma'ruf.

Meanwhile, Deputy Director of Cyber Investigation of Polda Metro Jaya AKBP Fian Yunus explained that the TNI Cyber Unit could not report Ferry Irwandy in the defamation case. This is stated in the Electronic Information and Transactions Law (UU ITE), after the Constitutional Court Decision (MK) Number 105/PUU-XXII/2024.

The Constitutional Court's decision states that the phrase other people' in Article 27A of the ITE Law must be limited only to individual individuals who feel aggrieved, and does not include government institutions, corporations, professions, or positions.
