Direct License Irregible In Copyright Law, Marcell: Must Be By Institutions With Operational Licensing
JAKARTA - Marcell Siahaan explained that the Copyright Law in principle does not provide the possibility of implementing direct license systems where users can pay royalties directly to songwriters or copyright holders and related rights.
According to him, copyright management, starting from withdrawal to distribution, must be carried out in a structured manner by institutions that have operational permits.
"In fact, the Copyright Law, why is it said that we cannot fundamentally direct license, the goal was that, everything was based on the fixed tariff," Marcell told the media crew at the DPR/MPR RI Complex, Central Jakarta, Thursday, August 21.
"Everything is based on structured collection, carried out by institutions that have operational permits, because this is the management of community funds," he added.
The singer, who has just been re-inducted as a commissioner of the National Collective Management Institute (LMKN), also rejected the assumption of weak supervision of LMKN and the Collective Management Institute (LMK).
He said LMK had carried out regular audits, in addition to supervision which was also carried out by LMKN.
"LMK's own code of ethics, independently as LMK, has audited every year," he said. "So, regardless of LMKN as an institution that monitors LMK regulations, they also have a code of ethics."

"Yes, because their suitability to maintain the code of ethics is what makes us issue an operational permit. Otherwise, the permit does not come out," he added.
Marcell also talked about the assumption that the distribution of royalties was not carried out clearly and transparently.
"Who said that from LMKN to LMK it was clear, but it was the problem and the culprit was the transparency of LMK to members," said Marcell.
"When asked about transparency, which is transparency? So indeed we have to consider what kind of mechanism, don't let the problem from LMK to members but the one who blames LMKN. Because the mechanism is different. We distribute everything to LMK to be distributed to members," he said.
