Minister Of ATR/BPN Nusron Wahid Accelerate Land Certification For Islamic Boarding Schools

JAKARTA - The Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) has accelerated the land certification process for places of worship and educational institutions, including Islamic boarding schools, so that it can be completed in the next three years.

Minister of ATR/Head of BPN Nusron Wahid said this certification covers waqf or non-waqf land, which is used for educational purposes.

"For the next three years, we want all land for places of worship and educational institutions, whether waqf or not, the certification can be completed," said Nusron in Cirebon, West Java, quoted by Antara, Saturday, August 2.

Until now, he said, the progress of certification has only reached 38 percent of the total target of 700 thousand plots of land.

He explained that educational institutions such as Islamic boarding schools and schools that are legal entities of foundations are not allowed to have property rights to land. However, there are exceptions for certain educational institutions.

"Especially for educational institutions, they are allowed to have property rights, as long as they get a letter of approval from the Minister of ATR/BPN," he said.

Nusron emphasized the importance of accelerating certification to avoid potential conflicts and legal disputes in the future, especially when there is a shift in the management of foundations or changes in land use.

"If it is not certified, this could cause a dispute in the future. This concerns legal certainty over the land of the people," he said.

He mentioned that the main obstacle in waqf land certification is the delay in the issuance of the Waqf Ikrar Deed (AIW), which is under the authority of the Ministry of Religion.

"If the land is waqf, it is usually slow in the AIW. That is at the Ministry of Religion. We hope there can be an acceleration from there," he said.

The government, according to him, will continue to encourage cross-ministerial cooperation, so that the process of certifying waqf and non-waq for education and places of worship can run more smoothly.

With this acceleration, the government wants to ensure the sustainability of the people's land social function while at the same time providing legal protection for their ownership and utilization.

"Therefore, don't let it become a dispute in the future," he said.
