Maintaining Indonesian Citizen Data In The Digital Age: Nurul Arifin Affirms The State Will Not Leave Its Hands

JAKARTA - Member of Commission I DPR RI, Nurul Arifin, responded to the polemic surrounding the management of Indonesian citizens' personal data (WNI) in trade cooperation between Indonesia and the United States.

He emphasized that the agreement was not a form of free submission of Indonesian citizens' personal data, but part of efforts to build valid, safe, and accountable cross-border data governance.

"This agreement actually becomes a strong legal basis for protecting Indonesian citizens' personal data, especially when using digital services from companies based in the United States, such as social media, search engines, cloud services, and e-commerce," said Nurul in a written statement to reporters, Wednesday, July 30.

According to the Golkar Party politician from the West Java I electoral district, the main principle in the cooperation is to maintain good data governance, protect individual rights, and uphold national law sovereignty.

He emphasized that transfer of cross-border personal data is only allowed for legitimate, limited, and has a clear legal basis.

"Supervision remains in the hands of the Indonesian authorities. Data transfer is carried out with the precautionary principle, in accordance with the provisions of Law Number 27 of 2022 concerning Protection of Personal Data and Government Regulation Number 71 of 2019 concerning the Implementation of Electronic Systems and Transactions," he explained.

Nurul also assessed that this collaboration puts Indonesia on par with G7 member countries such as the United States, Canada, Japan, Germany, France, Italy and the United Kingdom, which have implemented a safe cross-border data transfer mechanism.

"I believe the government has prepared this agreement with care. No one is harmed in this case because everything refers to the laws and regulations and the principle of mutual respect between the two countries," said Nurul, who is also a member of the commission in charge of international communication and relations.
