BNN Asks For KUHAP Revision Except For BNN Investigators Under Police Coordination

JAKARTA - The Legal Director of the National Narcotics Agency (BNN) Toton Rasyid requested that the revision of the Criminal Procedure Code (KUHAP) exclude BNN investigators from being under the coordination and supervision of police investigators.

Toton said that if BNN investigators under the coordination of the National Police, it would have a significant impact on their institutions. For example, the detention, determination of suspects, to submission of case files, needs to be coordinated with the Police.

"With the current condition of the concept, the current draft basis, the BNN investigator will be under the supervision of the National Police investigator," said Toton as quoted by ANTARA, Tuesday, July 15.

According to him, the draft revision of the Criminal Procedure Code which is currently being discussed explains that the investigation process, an investigator, is coordinated, supervised, and given instructions by police investigators. However, he said, this was excluded for investigators from the Attorney General's Office, the KPK, and the Navy.

He said narcotics crimes had been categorized as special crimes in Law Number 1 of 2023 concerning the Criminal Code (KUHP).

"The narcotics crimes committed by the National Police and BNN are investigators, in particular, they are not specifically used as certain investigators who are excluded from the Criminal Procedure Code," he said.

On the other hand, Toton said President Prabowo Subianto's administration was the only leader to put drug eradication into his vision and mission.

Based on these visions and missions, according to him, BNN also stated that narcotics abuse is a threat to humanity and civilization. According to him, BNN will also act repressively against drug syndicate networks and impoverish them.

However, said Toton, BNN ensures that it will be humane towards drug abusers and prioritizes the rehabilitation process.

Currently, Commission III of the DPR is discussing the revision of the Criminal Procedure Code which has 1,676 List of Problem Inventory (DIM).

The DIM discussion has now been completed at the working committee (Panja) level and has entered the stage of the Perumus Team and the Synchronization Team to adjust the changes that have been discussed.
