Residents Reject Land Dispute Mediation In Jatinegara Cakung, Suspects Land Mafia Interference

JAKARTA - Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency (ATR/BPN), Nusron Wahid, was asked to intervene over the polemic of land disputes suspected of involving the land mafia in East Jakarta.

The allegation of the rampant land mafia in East Jakarta can be seen from the land certificate issuance program which is currently being emphasized by the government. However, facts on the ground found different results.

One of the heirs named Madrais admitted that since 2018 his certificate had not been issued. According to Madrais, he was always given unreasonable reasons when questioning his certificate.

As is known, Madrais submitted a request for a certificate of part of his land covering an area of + 5000 M2 out of a total of 8330 M2 based on Girik C Number 454 Persil 10 S I in the name of Djimun Bin Nikun, while the remaining land area + 3300 M2 had already had a case with a decision rejected (not losing) and had been inkracht since 2013 according to Decision Number: Number: 139 / Pdt.G / 2004 / PN.Jkt.tim, dated April 14, 2005, Jo. Number: 128 / PDT / 2006 / PT. DKI, dated July 10, 2006, Jo. Number: 1444 K / Pdt / 2009, dated July 14, 2010, Jo. Number: 672 PK / PDT / 2012, dated April 17, 2013.

"On the +5000 M2 land area, East Jakarta BPN has previously conducted field research on the regulation of the Polda Metro Jaya according to the news of the research event of the East Jakarta Land Office No. 157/BA/SIP/JT/2018, dated July 19, 2018. The result was that the land was not included in the area owned by PT. Tarumah Indah which made the Director of PT. Tarumah Indah a defendant for renting out land belonging to Madrais Cs by using a fake letter with a sentence of 1 year in prison according to the decision number: 878/Pid.B/2019/PN.Jkt.tim, dated November 14, 2019, Jo. Number: 27/PDT/2020/PT. DKI, dated February 14, 2020, Jo. Number: 1292 K/Pid/2020, dated December 10, 2020 Jo. Number: 101 PK/Pid/2023, dated September 5, 2023," said Edy Wilson Harahap as the attorney of Madrais Cs heir. East Jakarta, Tuesday, June 10.

Then, continued Madrais, in 2022 he was asked to return to apply for a registration for measurements of part of his land, so that a Land Sector Map Number: 1390/2022 covering an area of 5237 M2 dated December 22, 2022 and a Letter of Ukur Number: 00254/ Jatinegara/2022 covering an area of 5327 M2, application for Madrais Cs dated January 4, 2023.

"After that, Slamet Sihabudin as the Head of Jatinegara Village and the party from East Jakarta BPN as Committee A with Madrais went directly to the land he requested. However, the Committee A's fault has not yet been made or signed for reasons of dispute, wanting to check the UN, there is no original girik, want to ask for instructions from the Regional Office and a thousand other reasons," he said.

Edy said, in the near future, the East Jakarta BPN will mediate between Madrais Cs and PT. Tarumah Indah.

"Right now, Djimun Bin Nikun's heirs have had no dispute with PT. Tarumah Indah since 2013. East Jakarta BPN is a service agency, not a judicial body to check Djimun Bin Nikun's lyrics," he said.

Edy emphasized that what mediation was carried out by the East Jakarta BPN which will be carried out on June 16, 2025, will be carried out.

"Why is the mediation and check Girik C Number: 454 Persil 10 SI covering an area of + 8330 M2 on behalf of Djimun Bin Nikun which is clearly registered in Book C Jatinegara Village and we have controlled it to date. Meanwhile, PT. Tarumah Indah's objection has no relevance to the ownership of Madrais Cs in other words Girik claimed by PT. Tarumah is clearly Different, namely Girik C Number: 454 Persil 10 S II covering 6720 M2 on behalf of MUSA BIN MUIN which Girik can be sure is not registered/ not registered in the Letter C Book of Jatinegara Village, Cakung District, East Jakarta," he said.

Head of the East Jakarta BPN Office Rizal Rasyuddin confirmed that his party would hold a second phase of mediation plan which will be carried out next week.

"After two mediations, I will report the results to the leadership of Pak Kakanwil. For further handling, according to the rules," he briefly confirmed yesterday.

Previously, it was reported that a resident of Cakung, East Jakarta, Madrais (76) was still fighting for the certificate of land inherited from his parents covering an area of 5,000 m2 in Jatinegara, Cakung.

Although it has been in charge since 2018 with complete documents, the East Jakarta National Land Agency (BPN) has not yet issued its certificate.
