SE Anti-Criminalization Of Manpower Proposed To Be Included In The Employment Bill

JAKARTA - Member of Commission IX DPR Zainul Munasichin proposed Circular Letter (SE) Number M / 6 / HK.04 / V / 2025 concerning Prohibition of Discrimination in the Manpower Recruitment Process to be strengthened to the level of legislation. He assessed that the existing points were included in the revision of Law Number 13 of 2003 concerning Manpower.

"I agree to raise the level. Later we will include it in the revision of the Manpower Law," Zainul told reporters quoted on Saturday, May 31.

Zainul further supported the move by the Minister of Manpower (Menaker) Yassierli to issue an anti-discrimination SE against the workforce. He hopes that the employer will no longer include discriminatory work conditions.

"So there should no longer be discrimination," he said.

"Things that are outside of competency matters are better removed and eliminated, I agree, yes, about physical matters, about religion, about race, no matter what, no more," he continued.

As previously reported, the Minister of Manpower (Menaker) Yassierli issued Circular Letter (SE) Number M / 6 / HK.04 / V / 2025 concerning Prohibition of Discrimination in the Manpower Recruitment Process on May 28, 2025.

There are four points in that circular. First, every citizen has the right to work and a decent living for humanity.

Second, employers are prohibited from discriminating on any basis in the labor recruitment process.

Third, the age requirements in the labor recruitment process can only be carried out if there are special interests with the following provisions:

a. for work or position that has properties or characteristics that actually affect a person's ability to carry out work and/or

b. should not have an impact on the loss or reduced chance of obtaining a job.

Fourth, the prohibition of discrimination and the provisions of age requirements in the labor recruitment process as above applies equally to workers with disabilities.
